Abstract:Načelo sorazmernosti je namenjeno omejevanju prekomernih posegov države v pravice posameznika. Toliko bolj pride do izraza v kazenskem postopku, ko prihaja do omejevanja svobode posameznika.

Abstract:The principle of proportionality constitutes a restriction on excessive government intervention in the rights of an individual and guidance for the legislature in formulating legal rules. It consists of a test of legitimacy, which is necessary to answer if the objective pursues a constitutionally admissible goal. The second part represents a proportionality test that consists of three questions. The measure is appropriate to achieve the objective, necessary to the extent that there is no lesser mean to achieve the objective and proportionate in the strict sense, which means weighing two modified rights. The principle of proportionality constitutes a measure for resolving constitutional judgments. Use of the proportionality test is mandatory for courts and public authorities when there exists a restriction of individual rights. The proportionality test requires assessment of individual rights and ensures that the right does not lose its essence. This is absolutely necessary in the criminal proceedings because of the individual freedom limiting. The Constitutional Court also uses the proportionality principle in cases of conflicts between two constitutional rights in private law relationships. Constitutional Courts weigh the values under which there are permissible restrictions on human rights and fundamental freedoms.
