Title:Pravica do zdravega okolja : primerjalnopravni vidik med Slovenijo in Združenimi državami Amerike

Abstract:Diplomsko delo opisuje ureditev pravice do zdravega okolja v Sloveniji in Združenih državah Amerike. Razdeljeno je na uvod in trinajst vsebinskih sklopov. Vsebina naloge govori predvsem o pravici do zdravega okolja v našem in ameriškem pravnem sistemu, o tem, kako je uvrščena v ustavni in zakonski sistem, poskušam pa prikazati tudi razvoj te pravice in ugotoviti, kakšne oblike pravnega varstva poznamo tako pri nas kot v Združenih državah Amerike. Pravico do zdravega okolja določa Ustava Republike Slovenije v 72. členu, v tretjem poglavju z naslovom Gospodarska in socialna razmerja. Državi je dana aktivna vloga pri varovanju okolja in ohranjanju naravnega ravnovesja, zato mora z zakonom urediti pogoje za upravljanje gospodarskih dejavnosti, pa tudi pogoje za poravnavo škode, ki je povzročena v življenjskem okolju. Ker pa žal nikjer ni zaslediti prave definicije zdravega življenjskega okolja, si jo marsikdo razlaga po svoje. Pravo nasprotje našemu pravnemu sistemu je ameriški pravni sistem, ki temelji na precedenčnem pravu (common law). Združene države Amerike pravice do zdravega okolja namreč nimajo zapisane v ustavi, njihovo okoljsko pravo temelji predvsem na štirih obsežnih zveznih zakonih: National Environmental Policy Act, Endangered Species Act, Clean Water Act, in Clean Air Act. Čeprav pravica do zdravega okolja ni ustavno varovana dobrina, skozi pisanje diplomske naloge vse bolj ugotavljam, da je ta pravica v Združenih državah Amerike kljub temu bolj spoštovana in lažje iztožljiva kot pri nas.

Title:Pravica do zdravega okolja - primerjalnopravni vidik med Slovenijo in Združenimi državami Amerike : diplomsko delo
Abstract:In my diploma thesis I have described regulation of rights to a healthy environment in Slovenia and the United States. It is divided into introduction and thirteen concent assemblies.The content of the task speaks particulary about the right to a healthy environment in our and the American legal system. I have tried to present also developement of this right, how it is included in constitutional and legal system and to find out what forms of legal protection we know as in our country as in the United States. Constitution the Republic of Slovenia provides the Right to a healthy environment in Article 72, in the third section with address Economic and social relations. Our state is given active role at environmental conservation and pressuring ecological balance, in order to regulate with statute for management of economic activities and also conditions for settelment of damage caused in life anvironment. Unfortunately, there is nowhere to find the true definition of healthy life environment so many people interprete it of their own. The exact opposite to our legal system is American legal system, based on the precedent law (common law). The United States do not have written the right to a healthy environment in the Constitution. Their environmental law based primarily on four extensive federal laws: National Environmental Policy Act, Endangered Species Act, Clean Water Act and Clean Air Act. Althoughthe right to a healthy environment is not constitutionally protected value, whille writing this thesis, I have found out more and more that this right is more respected in the USA and more easily legally enforceable than in our country.
