Title:Uveljavljanje pravic iz javnih sredstev : diplomsko delo

Abstract:V sodobni družbi se velik pomen namenja socialni varnosti, za katero v večji meri skrbi država. Ustava RS določa, da je Slovenija pravna in socialna država, kar se izraža tako, da osebam, ki so potrebne pomoči, s socialnim varstvom zagotavlja socialnovarstvene storitve oziroma prejemke, med katere spadajo tudi pravice iz javnih sredstev. Kadar vstopamo v pravno razmerje z državo, govorimo o upravnopravnem razmerju, kjer organi oblasti odločajo v posameznih upravnih zadevah iz različnih upravnih področij po zakonsko predpisanem postopku. Splošen upravni postopek ureja Zakon o splošnem upravnem postopku (ZUP). Postopek uveljavljanja pravic iz javnih sredstev spada med posebne upravne postopke, ki ga ureja specialni predpis, Zakon o uveljavljanju pravic iz javnih sredstev (ZUPJS). Če ZUPJS določenega vprašanja postopka ne obravnava, se dopolnilno uporabi ZUP. Poleg postopkovnih določb oba zakona vsebujeta tudi temeljna načela, minimalne procesne standarde, ki morajo biti zagotovljeni strankam v vsakem postopku. Med temeljna načela spadata tudi pravna varnost in varstvo pravic strank v postopku. Predloženo diplomsko delo primerjalno predstavlja splošni upravni postopek (ZUP) in posebne postopkovne določbe ZUPJS. S primerjavo obeh postopkov je bilo ugotovljeno, da so načela pravne varnosti in varstva pravic strank s posebnimi postopkovnimi določbami ZUPJS ustrezno zagotovljena, saj le-ta zagotavljajo višji standard varnosti. Načelo pravne varnosti in varstva pravic pa seveda tudi zahteva, da se država oziroma njen zakonodajni organ odziva na družbene spremembe in potrebe svojih državljanov in temu ustrezno prilagaja tudi vsebino pravic in način njihovega uveljavljanja in zagotavljanja.

Abstract:Modern society gives a great importance to social security which is mostly the concern of the state. The Constitution of the Republic of Slovenia stipulates Slovenia as a legal and welfare state, which is expressed also in providing a proper social assistance to persons who need help and social security services. This includes the rights of public funds. When entering a legal relationship with the state, we are talking about an administrative-legal relationship where the authorities decide in individual administrative matters from different administrative areas according to the statutory procedure. The general administrative procedure is governed by the General Administrative Procedure Act (ZUP). The procedure for enforcement of rights of public funds is one of the special administrative procedures, which is regulated by a specific regulation; Exercise of Rights from Public Funds Act (ZUPJS). If the ZUPJS does not deal with a particular issue of the procedure, it is supplemented by ZUP. In addition to procedural rules, both Acts also contain fundamental principles, minimum procedural standards that must be provided to applicants in each proceeding. The fundamental principles also include legal certainty and the protection of the rights of parties in proceedings. The submitted thesis presents comparative general administrative procedure (ZUP) and special procedural provisions of ZUPJS. By comparing both procedures, it was determined that the principles of legal certainty and the protection of the rights of applicants with specific procedural provisions of ZUPJS are stipulated accordingly since they provide a higher standard of security. The principle of legal security and protection of rights of partie's involved, of course, also require that the state or its legislative body responds to the social changes and needs of its citizens, and accordingly adjust the content of rights and the manner of their enforcement and assurance in due time and mode.
