Title:Načelo enakosti in pravno varstvo materinstva : diplomsko delo

Abstract:Urejanje področja varstva starševstva in materinstva je družbeno določen proces, ki sledi družbenim spremembam ter novim družbenim razmerjem in vrednotam, hkrati pa lahko družbeno stvarnost pomembno sooblikuje. Osrednje mesto pri urejanju in reformah omenjenega področja zavzema skozi čas spreminjajoča se vloga ženske - matere v družbenih razmerjih, posledično pa tudi nova vloga očeta, vzpostavljanje novih odnosov znotraj družine in v razmerju družine do družbene skupnosti. Tako se na področju starševstva vedno znova pojavlja tudi potreba po drugačnem urejanju pravic obeh staršev. Starševstvu in materinstvu je namenjena mednarodna in nacionalna zaščita, ki se razteza na široko področje pravnega urejanja in je usmerjena k izenačevanju možnosti depriviligirane skupine in s tem udejanjanju načela enakosti med spoloma ter med družinami z otroki in brez njih, zagotavljanju (bolj) enakovrednih možnosti za uveljavitev posameznikov na vseh družbenih področjih pa tudi varovanju splošnih družbenih interesov. Z ustrezno zakonodajo in ukrepi družinske politike se tako zagotavljajo formalne možnosti, ki zopet povratno vplivajo na dejansko stanje in nastajanje novih razmerij v družbi.

Abstract:The regulation of the field of parenthood and motherhood protection is a socially determined process that goes hand in hand with changes in the society as well as with new social norms and values. At the same it effects the society and alters it significantly. The focus of the regulation and reformation of the aforementioned process is the woman-mother role within the social relations which developed and altered in the course of time. It consequently effects the father's role as well, which takes on a new value, further, it effects and recreates new relations within the family unit and it affect the way it relates with social society. Eventually all the previously mentioned processes and changes lead to an urge to reform the rights in the field of parenthood, afflicting both parents equally. Needless to say, parenthood and motherhood are under international as well as national protection, a protection that stretches from the vast fields of legal regulation and beyond, into the field of granting equal rights to deprivileged groups, thus enabling both genders and families with children and without them equal rights before the law. Moreover, it ought to grant equal opportunities to individuals in their entirety and protect general social interests. By applying appropriate legislation as well as other measures of family policy formal opportunities are created, which then in turn reflect upon and affect the actual situation in the society, thus leaving opportunities for creation of new relations within the society.
