Title:Capital punishment in the United states of America : bachelor thesis

Abstract:The aim of this bachelor's thesis is to present the use of death penalty in United States of America, and to analyse how its use affects the everyday lives of prisoners as well as the criminal system as a whole in the American society. The thesis is presented in three parts. The first part presents its historical background and how capital punishment arrived to United States and began to integrate in its common law penal system. The second part presents the use of death penalty in practice today, which states in America still use it, and this part concentrates mainly on different aspects and problems that arise from its use, such as the negative economic view, the very alarming discrimination and it rebuts arguments such as deterrence, incapacitation as well as retribution. The last part touches mainly upon the political system in the United States and it tries to analyse why such a powerful country, which sees itself as an example to other democracies, still uses such form of punishment. In this last part the thesis talks about political institutions and parties, complex and bias court processes, as well as international treaties and organizations that have become very influential in fighting against capital punishment. This thesis consists of nine chapters, each of them systematically dealing with the subject.

Abstract:Cilj diplomske naloge je predstaviti uporabo smrtne kazni v Združenih državah Amerike in analizirati kako vpliva na vsakodnevno življenje zapornikov, kot tudi kakšno težo ima v ameriškem sistemu kaznovanja. Diplomsko delo je razdeljeno na tri dele. Prvi del je historičen, saj predstavi kako so britanske kolonije razširile prakso smrtne kazni in kako se je kaznovanje s smrtno kaznijo integriralo v ameriški pravni sistem. Drugi del predstavi uporabo smrtne kazni v ameriškem sistemu kakor je v praksi danes in katere države jo še vedno uporabljajo. Drugi del predstavi težave, ki nastajajo zaradi uporabe tovrstnega kaznovanja, med drugim negativni finančni vidik smrtne kazni in seveda ogromne diskriminacije. V tem delu izpodbijemo argumente kot so odvračanje, povračilo in onesposobitev. Zadnji del govori predvsem o ameriškem političnem sistemu in analizira kako je mogoče, da tako napredna država kot je ZDA, ki sama sebe vidi kot vzor drugim demokratičnim državam, še vedno uporablja tovrstno kaznovanje. V tem tretjem delu govorimo o političnih institucijah in strankah, kompleksnih sodnih postopkih kot tudi mednarodnih pogodbah in organizacijah, ki se borijo proti smrtni kazni. Vsebina diplomskega dela je razdeljena na devet poglavij, ki se sistematično ukvarjajo z zgoraj navedeno tematiko.
