Title:Landtová kot sodba ultra vires. Kaj to pomeni za načelo primarnosti?

Abstract:Tako kot se razvija in spreminja Evropska Unija, se tudi razvija in spreminja njen pravni red. Razmerje med pravnim redom Evropske unije in pravnimi redi držav članic ureja načelo primarnosti. To načelo ureja situacije, ko sta ta dva pravna reda v konfliktu in razrešuje vprašanje, katero pravo naj se uporabi pri njihovem vzajemnem nasprotovanju. Preko judikature Sodišča Evropske unije se je oblikovalo stališče, da ima pravo EU prednost pred nacionalnim pravom. Ob tem se moramo zavedati, da EU deluje v obsegu prenesenih pristojnosti in v primeru, da je pravni akt zunaj tega okvirja, mu ne moremo dati prednosti. V primeru konflikta ali celo kršitve načela primarnosti ni nobene nadrejene instance ali razsodnika, ki bi lahko natančno določil katero pravo naj uporabimo, upoštevajoč dejstvo, da sta ta dva pravna reda v heterarhičnem razmerju. Zadeva C-399/09 M. Landtová proti ČSSZ oz. posledice le-te je tipičen primer nasprotovanja teh dveh pravnih redov in označba sodbe kot "ultra vire" s strani Ustavnega sodišča ČR to zelo jasno dokazuje. V tej nalogi poleg podrobne analize celotnega problema preučujem in predstavljam agumente za in nasprotne argumente v zvezi z ravnanjem Ustavnega sodišča. Argumenti bodo preučeni na podlagi odločitev tako Ustavnega sodišča ČR kot tudi na podlagi odločitev Vrhovnega upravnega sodišča in navsezadnje na podlagi številnih mnenj in komentarjev s strani čeških in tujih pravnih strokovnjakov. Ob tem velja poudariti, da celoten problem ne zajema samo omenjenega primera ge. Landtové, ampak celo vrsto primerov, ki so se začeli pojavljati po razpadu takratne Češko-slovaške federativne republike ter pri uporabi Pogodbe med Češko in Slovaško republiko o socialni varnosti.

Title:Landtová kot sodba ultra vires: kaj to pomeni za načelo primarnosti?
Abstract:Just as evolving and changing the European Union, is also evolving and changing its legal system. The relationship between the acquis and the laws of the Member States is governed by the principle of primacy. This principle governs situations where these two legal orders are in the conflict and resolves the question of which law should be applied in their mutual objections. Through case law of the European Court of Justice has formed the opinion that EU law takes precedence over national law. At the same time we must be aware that the EU is acting within the scope of delegated powers and in the event that the act is outside this box, it can not give advantages. In the event of a conflict or even a breach of the principle of the primacy of no parent instance or arbitrator that could accurately determine which law should be used taking into account the fact that these two legal orders in heterarchical relationship. Case C-399/09 M.Landtová against ČSSZ is a typical example of opposition to these two legal orders and the designation of judgment as''ultra vires'' by the Constitutional Court of the Czech Republic it very clearly demonstrates. In this thesis, beside a detailed analysis of a case, I present also arguments "pro" and "contra" concerning the conduct of the Constitutional Court. Arguments will be studied based on decisions of the Constitutional Court of Czech Republic and also on several opinions and comments made by Czech and foreign law experts. At the end it is also important the fact that the problem does not include only Landtova case but also many other cases. These cases started to appear after the dissolution of the Czech and Slovak Federal republic and by using the Agreement on Social security between the Czech republic and Slovak republic.
