Title:Diskrecijska pravica in nedoločeni pravni pojmi : diplomsko delo

Abstract:Diskrecijska pravica in nedoločeni pravni pojmi v marsikaterem pogledu s strani družbe niso obravnavani kot pozitivna, temveč prej kot dodatna pravica, podeljena upravnemu organu. Če pogledamo iz drugega zornega kota, pa se v vsakdanjem življenju lahko srečamo z vrsto nepričakovanih situacij, ki jih ni moč predvideti vnaprej. Diplomsko delo nazorno opredeli omenjene pojme v povezavi s temeljnimi načeli, ki morajo biti strogo upoštevana za izdajo zakonite upravne odločbe,izdane na podlagi prostega preudarka.Odločanje po prostem preudarka ne sme biti samovoljno, pravno nevezano ali arbitrarno. Diskrecija je upravnemu organu podeljena zgolj na podlagi zakonske ali podzakonske norme, pri tem pa se srečuje z več omejitvami. Posamični upravni akt mora biti izdan v mejah pooblastila, v skladu z namenom danega pooblastila, biti pa mora tudi utemeljen in obrazložen.Te omejitve tako izpodbijajo domnevo o samovoljnem oziroma arbitrarnem delovanju pristojnega organa. Ker v praksi prihaja tudi do kršitve ali zlorabe diskrecijske pravice, pa so vsakemu posamezniku kot pravno varstvo zagotovljena tudi ustrezna pravna sredstva, v primeru nezakonitega poseganja v pravice, obveznosti ali druge pravne koristi strank v postopku. Za širši pogled na prosti preudarek pa diplomsko delo zajema tudi primerjavo z njegovo ureditvijo v nekaterih drugih evropskih državah ter razmerje med institutoma diskrecijske pravice in nedoločenih pravnih pojmov.

Abstract:Discretionary right and unspecified legal concepts in many aspects are not considered by the society as a positive but rather than the additional right granted to the administrative body. But if we look at the matter from another angle, in the ordinary life, we can come across a series of unexpected situations that canbe unpredicted in advance. So the thesis includes a more precise definition of those concepts in connection with the fundamental principles that must be strictly observed, for the lawful administrative decision on the basis of discretion to be legal. Discretionary right mustnot be arbitrary or unlawful. The discretionary rightis granted to the administrative body solely and only onthe basis of a statutory or subordinate norm, but it encounters several limitations. The administrative decision must be issued within the limits of the permission, in accordance with the purpose of the given authorization, but must also be justified and reasoned. These restrictionsare challenging the presumption of arbitrary action by the competent authority. However, since in practice there is a violation orabuse of discretion, appropriate remedies are provided to each individuals legal protection incase of unlawful interference with therights, obligations or other legal advantages of the parties to the proceedings. For a broader view of the discretionary right, the final work also includes the comparison with its regulation among some other European countries and the relationship between the institute's discretion and unspecified legal concepts.
