Title:Zapletenost postopka posvojitev : diplomsko delo

Abstract:Posvojitev (adopcija) , kot prastar statut je postopek, v katerem določena oseba prevzame starševstvo nad nekom s katerim ni v bližnjem sorodstvu. Adopcijo ureja Zakon o zakonski zvezi in družinskih razmerjih. Med mednarodni pravnimi viri v Sloveniji veljajo tudi določene konvencije, ki zadevajo posvojitve. Poleg tega ima Slovenija sklenjen tudi bilateralni sporazum z Makedonijo, ki ureja potek posvojitev med tema dvema državama. Zakon določa pogoje, ki morajo biti izpolnjeni, da je posvojitev mogoča in pa ogrodje postopka samega. Vse ostalo je prepuščeno delavcem na centrih za socialno delo, tako da je od njihove presoje odvisno komu gredo otroci, ki so namenjeni posvojitvi. Kot največji problem postopka se kaže njegova nedorečenost. Obstajajo različne prakse glede na center za socialno delo, to pa prinaša precej razlik in posledično nejevolje. Nekateri očitajo tudi manjk strokovnosti, ki naj bi se predvsem kazal pri pripravah bodočih posvojiteljev na starševstvo. V ta namen pa imamo pri nas dve društvi, ki se trudita, da bi se ta težava odpravila in bi bili bodoči starši kar se da pripravljeni na posvojitev. Ker je v Sloveniji otrok, ki izpolnjujejo pogoje za posvojitev malo, staršev, ki bi želeli otroka posvojiti pa veliko, se nekateri poslužujejo mednarodnih posvojitev. Tako nacionalne kot mednarodne posvojitve, pa morajo imeti v prvi vrsti za cilj korist otrok in v tej smeri voditi celotni. postopek.

Abstract:Adoption, as an ancient statute, is the procedure in which a certain person takes on the parenthood of a child with whom he is not in close relations. Adoption is regulated by the Marriage and Family Relations Act. In Slovenia, in addition to international sources of law, there also exist certain conventions, which relate to adoption. Besides this, Slovenia also has agreed-to bilateral agreement with the Former Yugoslav Republic of Macedonia, which regulates the process of adoption between the two countries. The Act sets forth conditions, which are required to be fulfilled, so as to make the adoption possible and also set the framework for the procedure itself. All other details are left to social workers at social work centres, so that it is left to their judgement in determining where children go, and who are intended for adoption. The biggest problem of the procedure has shown itself to be inconsistency, as differing work practices with respect to social work centres exist, bring with them considerable differences and, consequentially, annoyance. Some criticize due to a lack of expertise, which is said to show itself in the preparation of future adoption seekers. For this purpose, we have two societies, which strive to eliminate such problems so that parents-to-be are prepared as best as is possible for adoption. Because there are few children who fulfil the conditions for adoption in Slovenia, and a considerable number of parents who wish to adopt a child, some of them resort to international adoption. And so, as with national as well as international adoption, they must first have the interests of the child in mind, and from that point forward, lead the entire procedure.
