Title:Etični in pravni vidiki presaditve tkiv in organov v Republiki Sloveniji : magistrsko delo

Abstract:Uvod: Transplantacijo organov in tkiv lahko danes uvrščamo med uveljavljene oblike zdravljenja. Zarisati jasno razmerje med darovanjem organov in pravom se na prvi pogled zdi preprosto, vendar hitro ugotovimo, da gre za izredno kompleksno razmerje. Razloge za to gre iskati v različnih vidikih transplantacije, kot so: etični, medicinski, ekonomski, politični in pravni vidik. Namen in cilj: Namen magistrskega dela je s pregledom strokovne literature zbrati podatke o pomenu dobre pravne urejenosti transplantacijske dejavnosti v našem prostoru, ugotoviti dejanski trenutni pravni položaj transplantacije organov v Republiki Sloveniji ter poiskati pomanjkljivosti našega pravnega sistema v povezavi s to tematiko. Cilj magistrskega dela je na enem mestu zbrati in opisati pravne predpise, ki se nanašajo na transplantacijo organov, ugotoviti pomanjkljivost in predlagati možne izboljšave. Metode dela: Pri izdelavi magistrskega dela smo uporabili deskriptivno metodo s študijem domače in tuje literature, pri tem pa primerjali različne vire, ki se nanašajo na postavljene hipoteze. S pomočjo sistematične sekundarne analize različnih virov in deskriptivne raziskave smo prišli do podatkov, s pomočjo katerih smo oblikovali teoretični del magistrskega dela. Zaključek: Transplantacija organov je izredno občutljiv in kompleksen proces, ki ga spremljajo etične in pravne dileme. Prav je, da se vsak sam opredeli do transplantacije in ravna v skladu s svojimi prepričanji, naloga zakonodajalca in strokovne javnosti pa je, da zagotavljata pogoje, ki omogočajo varen in etično sprejemljiv okvir izvajanja transplantacijske dejavnosti. Transplantacijska dejavnost bo na ta način pridobila na veljavi in postala bolj sprejemljiva v očeh širše javnosti.

Abstract:Introduction: Nowadays, organ and tissue transplantation can be defined as an established form of treatment. At first glance, it seems easy to delineate a clear relation between organ donation and the law, but soon after we realize, that the relation is extremely complex. The reasons for this derive from different aspects of transplantation, e.g.: ethical, medical, economic, political and legal. Purpose and goals: The purpose of the Master's thesis is to review professional literature and collect data on the importance of good legal regulations of transplant activities in our area, to determine the actual current legal situation of organ transplantation in the Republic of Slovenia and find weaknesses of our legal system in connection with this topic. The goal of the Master's thesis is to collect and describe legal regulations concerning organ transplantation, determine weaknesses and suggest possible improvements in a single document. Work methods: In the Master's thesis, we used the descriptive method with a study of domestic and foreign literature. We compared different sources relating to the set hypothesis in the Master's thesis. With the help of systematic secondary analysis of different sources and the descriptive research, we came to the data, with the help of which we could prepare the theoretical part of the Master's thesis. Conclusion: Organ transplantation is an extremely sensitive and complex process with ethical and legal dilemmas. It is right, that each individual decides for himself, if he wants to become a donor, and acts according to his beliefs. However, the task of the legislator and the specialized public is to ensure conditions, which allow a safe and ethically accepted framework for transplantation activities. This way, the transplantation activities will gain on importance and become more acceptable by the general public.
