Title:Odgovornost države za škodo, ki jo povzočijo javni uslužbenci in funkcionarji : diplomsko delo

Abstract:Odgovornost države za škodo, ki jo povzročijo javni uslužbenci in funkcionarji, je poseben pravni institut, v katerem se prepletata področji upravnega, delovnega in civilnega prava. Temeljni vir za uveljavljanje te odgovornosti je vsebovan v 26. členu Ustave RS, ob tem pa obstajajo tudi številne druge določbe zakonodaje s področja civilnega odškodninskega prava, ki so pomembne za vsebino moje naloge. Glede instituta odgovornosti države za škodo nas zanima predvsem njegov nastanek, razvoj ter njegova uporaba na pravnem področju. Pri tem se bomo ukvarjali z raziskovanjem problematike zagotavljanja pravne varnosti državljanom, pa tudi pravnim osebam zasebnega prava. Vsi navedeni subjekti so aktivno legitimirani za sprožitev tožbe zoper državo na podlagi odškodninske odgovornosti za škodo, ki jim je bila povzročena v postopkih, ki jih vodijo javni uslužbenci ali funkcionarji. Pravna teorija in pravna praksa namenjata veliko pozornosti obstoju določenih predpostavk za odškodninsko odgovornost države, kjer se protipravnost, škoda, vzročna zveza med njima in krivda vsaj delno presojajo po drugačnih merilih kot v splošnem civilnem pravu.

Title:Odgovornost države za škodo, ki jo povzročijo javni uslužbenci in funkcionarji
Abstract:State liability for damage caused by public employees and functionaries is a special kind of law institute, where the field of administrative, labour and civil law interwine. The fundamental source of state liability is contained in Article 26 of the Constitution, but there are also many other provisions of civil law legislation that are relevant to the content of my thesis. We are intrested mainly in making, evolving and use of this institute from the legal point of view. In this regard, we will explore the problem of providing legal security to citizens, as well as legal entities of private law. All of those entities are actively legitimated to file a lawsuit against the State on base of its tort liability for damages that were caused during the proceeding by a public employee or a functionary. Legal theory and legal practice pay great attention to the existence of certain assumptions for the liability of the State in which the unlawfulness, damage, causal link between them and the fault are judged at least partially by different criteria than in general civil law.
