Title:Pravica gluhih oseb do uporabe svojega jezika : magistrsko delo

Abstract:Magistrska naloga predstavlja pravico gluhih oseb do uporabe svojega jezika, pri čemer se sklicuje na relevantne domače in tuje vire ter mednarodne dokumente, deklaracije, konvencije in resolucije ter slovenski zakonodajni okvir, ki opredeljuje način uresničevanja pravice do uporabe svojega jezika. Pri tem je primerjalna raziskava pokazala, da gluhe osebe naletijo na številne ovire pri uresničevanju te pravice, kar je po eni strani posledica nepoznavanja določil Zakona o uporabi slovenskega znakovnega jezika, kot specialnega zakonodajnega akta, ter po drugi strani neusklajenosti področne zakonodaje z določili krovnega zakona. Z raziskavo je ugotovljeno, da je gluho skupnost potrebno prepoznati kot jezikovno manjšino na temelju Evropske listine o regionalnih ali manjšinskih jezikih, saj izpolnjuje navedene kriterije. Izhajajoč iz določil Evropske listine bi bila gluhim osebam oziroma gluhi skupnosti omogočena lažja dostopnost do njihovih temeljnih pravic in posledično lažja uveljavitev v postopkih pred državnimi organi.

Abstract:The subject of the Masters thesis paper focuses on the right of deaf people to use oneʼs own language. The author quotes various aspects of provision of this right from a number of national and international sources, International Documents, Declarations, Conventions and Resolutions, as well as Slovenian legal framework, which defines the method of exercising the right to use oneʼs own language. Comparative survey carried out in the framework of thesis research has shown that the deaf are encountering a number of obstacles in exercise of the right to use oneʼs language, which on the one hand is due to lack of knowledge of provisions of the Act on Use of Slovenian Sign Language, as a specialised legal act, and poor harmonisation of this area of legislation with the umbrella act on the other. The conclusions of the survey have shown that the deaf community should be recognised as a language minority on the grounds of European Charter on Regional and Minority languages, as it fulfils all the relevant criteria. Resulting from provisions of the European Charter, the deaf, i.e., the deaf community would enjoy better access to their fundamental rights and consequently be able to fully exercise their rights in procedures with public authorities.
