Title:Pravna ureditev stvarnih služnosti v RS in vpliv na vrednost nepremičnin : magistrsko delo

Abstract:Magistrsko delo obravnava pravno ureditev stvarnih služnosti v Republiki Sloveniji in njihov vpliv na vrednost nepremičnin. Poznavanje pravnega sistema stvarnega prava kot dela civilnega prava je osnova za razumevanje stvarne služnosti in z njo povezanega vpliva na vrednost nepremičnin. Glavni poudarek magistrskega dela je na izvedeni javnomnenjski raziskavi, s katero smo pridobili podatke o poznavanju instituta lastninske pravice, služnostne pravice, pridobitve, prenehanja in upravičenj. Ugotavljamo, ali je lastninska pravica, omejena s stvarno služnostjo, ovira pri odločitvi za nakup in ali obstoj služnosti zmanjšuje vrednost nepremičnine. Magistrsko delo je zastavljeno tako, da kompleksno in podrobno opredeljuje pravno ureditev stvarnih služnosti v Republiki Sloveniji in bistvene institute, pomembne za razumevanje obravnavanega področja. Razdeljeno je na tri večje sklope, in sicer na prvi, uvodni del, drugi, teoretični del in tretji, empirični del. V uvodnem delu so opredeljeni problem in teoretična izhodišča, namen in cilji naloge, raziskovalne metode, predstavljeni so hipoteze, zgodovinski razvoj, pravni viri in temeljna načela stvarnega prava. V teoretičnem delu so predstavljeni institut lastninske pravice, služnosti, stvarne služnosti, osebne služnosti, neprave stvarne služnosti in služnosti v javno korist. Predstavljen je vpis služnosti v zemljiško knjigo kot pravni institut oziroma segment zemljiškoknjižnega prava. Tretji del je empirični del naloge, ki je usmerjen v lastno raziskavo, izdelano na podlagi anketnega vprašalnika in intervjuja. Ugotovili smo, da posamezniki, vključeni v raziskavo, menijo, da lastninska pravica, ki je omejena s stvarno služnostjo na nepremičnini, ni ovira pri odločitvi za nakup nepremičnine. Nadalje smo ugotovili, da obstoj služnosti posamezniki, vključeni v raziskavo, povezujejo z zmanjšanjem vrednosti nepremičnine, pri tem pa se ocena bistveno ne razlikuje glede na to, ali so nepremičnine obremenjene s stalno ali začasno služnostjo, z enim ali več upravičenci.

Abstract:The master's thesis deals with the regulation of easement in Slovenia and its impact on property values. Knowledge of the legal system of property law as a part of the civil law is the basis for understanding the easement and its related impact on property values. The main focus of the master's work is an opinion poll in which we collected data on knowledge of the institution of property rights, easements, acquisition and termination of entitlements. We researched, whether in the case when the property right is limited by a real easement, this is an obstacle for willingness of a person to purchase such property and whether the existence of an easement reduces the value (purchase price) of the property. Master's thesis is conceived in such a way that it profoundly and in more detail explains the legal regime of easements in the Republic of Slovenia and basic legal institutes, important for the understanding of the subject matter of the thesis. It is divided into three major parts, the first introductory part, the second theoretical part and the third empirical part . In the first, introductory part, it defines the problem and the theoretical foundations, the purpose and aims of the project, research methods, presentation of hypotheses, historical development, sources of law and the fundamental principles of property law. In the second theoretical part sets forth the institution of property rights, in rem easements, personal easements, quasi-easements and easements in the public interest. The rules of entry of an easement in the land register are also explained . The third part is the empirical part of the thesis, which is focused on the research, performed by a method of a questionnaire and an interview. We have found that the individuals included in the study believe that the property right, which is encumbered by a real easement on the property, does not constitute an obstacle for the decision to purchase such property. Furthermore, we found that the existence of an easement individuals included in the study associated with reducing the value of the property, while the estimate is not significantly different depending on whether the property encumbered with permanent or temporary easement and, by one or more beneficiaries.
