Title:Problem samoodločbe Katalonije : diplomsko delo

Abstract:Načelo mednarodnega prava o pravici do samoodločbe se je skozi zgodovino spreminjalo, vendar se njegov razvoj niti v današnjem času ni zaustavil in še vedno poteka. Nekateri avtorji pravico do samoodločbe opredeljujejo kot pravico, ki je obstajala v času kolonialnih narodov, spet drugi kot pravico, ki obstaja tudi izven procesa dekolonizacije. V pričujočem diplomskem delu se poleg splošne opredelitve pravice do samoodločbe posvetimo tudi pravici do samoodločbe na primeru Katalonije. Katalonija je ena izmed sedemnajstih avtonomnih skupnosti Španije, ki si želi osamosvojitve od Španije. Španija kot unitarna država ne priznava obstoja Kataloncev kot naroda in njihove pravice do samoodločbe. Državi sta zato v zadnjem času v velikem navzkrižju. Razplet katalonskega vprašanja pa ni zanimiv le z vidika konflikta med Španijo in Katalonijo, temveč tudi za Evropsko unijo in nenazadnje za celotno mednarodno skupnost. Z vidika Evropske unije je zanimivo predvsem vprašanje, kaj bo s Katalonijo, če postane samostojna država. Ali jo bo Evropska unija takoj priznala kot državo članico ali bo morala zaprositi za članstvo? Glede mednarodne skupnosti pa se lahko zgodi, da bo prav Katalonija postala precedenčni primer osamosvojitve, po katerem se bodo zgledovali tudi drugi narodi, ki si želijo samostojnosti. Dejstvo pa je, da različna mnenja, dojemanja in tolmačenja pravice do samoodločbe negativno vplivajo na svetovni mir in varnost.

Abstract:The principle of international law on the right to self-determination has been changing significantly through time. Some authors believe that the right to self-determination existed as early as the colonial period, while other perceive it as a right that also exists beyond the context of decolonisation. This thesis deals with the general aspect of the right to self-determination as well as the use of this right in the case of Catalonia. Catalonia is one of Spain's seventeen autonomous communities and it would like to gain independence. Spain is a unitary state and as such does not recognise neither the existence of Catalans as a nation nor their right to self-determination. As a result, the two states have recently clashed. However, the resolution of the Catalan issue is interesting not only from the perspective of the conflict between Spain and Catalonia, but also for the European Union and the international community as a whole. The main question arising in the European Union is: what will happen to Catalonia if it becomes an independent state? Will the European Union grant membership automatically or will Catalonia have to apply for membership? As far as the international community is concerned, Catalonia may as well become a precedent case of gaining independence, which mens that other nations pursuing the same goal may follow its example. However, it is important to note that different opinions, perceptions and interpretations of the right to self-determination have a negative impact on international peace and security.
