Title:Varstvo dostojanstva na delovnem mestu : magistrsko delo

Abstract:Varstvo dostojanstva je ključna komponenta na poti do človekove samouresničitve. Je osnovna človekova pravica in vrednota, ki mora biti spoštovana na vseh področjih - tudi na delovnem mestu. A ker je pogosto kršena, je namen pričujočega pisanja ozaveščati posameznike o varstvu njihovih pravic in pomagati delodajalcu, da se zavaruje pred posledicami, ki jih prinaša zloraba pravice do osebnega dostojanstva na delovnem mestu. Z razvojem družbe se povečuje konkurenca med podjetji in bitka za uveljavitev na trgih pogosto povzroči stresne okoliščine ali pritiske na delovno silo. Pogosta posledica je rivalstvo med zaposlenimi. Boj za položaj lahko pripelje tudi do podtikanj, groženj in povzročanja strahu, kar prizadene osebno dostojanstvo posameznika. Kršitev dostojanstva na delovnem mestu je v domači in tuji literaturi poimenovano z mnogimi izrazi, vedno pa je prisotno izvajanje nasilja. V nalogi smo predstavili vzroke, ki privedejo do posegov v dostojanstvo na delovnem mestu, in kršitve, ki takšne posege spremljajo. Izvajanje mobinga je sistematičen proces, katerega cilj je izriniti posameznika iz delovne sredine, zato smo predstavili tudi njegovo dinamiko. Poglaviten namen proučevanja teme je predstaviti varstvo delavca in vloge subjektov, ki morajo biti vključeni v takšno varstvo. Za zajezitev problema so najpomembnejši preventivno delovanje, ozaveščenost in ukrepanje. Ko je mobing prepoznan, to ni le problem žrtve, temveč postane problem celotne organizacije, družbe in države. V ta namen smo predstavili vlogo žrtve, sodelavcev, delodajalca, ostalih združenj in državnih politik. S predstavitvijo sodne prakse v Sloveniji smo želeli izpostaviti pomembnost poznavanja sistematičnega reševanja problema, kjer je poglavitno poznavanje zakonodaje. Žal Slovenija še vedno spada med države, kjer kršitev dostojanstva na delovnem mestu narašča, zato smo za primerjavo predstavili tudi varstvo te pravice v drugih evropskih državah. Cilj pisanja je ozaveščati posameznike, predstaviti posledice organizacijam in napotiti državne politike k doslednejšemu nadzoru. Kršenje dostojanstva na delovnem mestu prinaša hude posledice, saj uničuje pravno državo, zdravo družbo, prazni zdravstveno blagajno, znižuje socialno blaginjo, zmanjšuje produktivnost podjetij, načenja odnose v družini in kvari psihofizično stanje posameznika.

Abstract:Protection of dignity is a key component on the path to human self-realization. It is a basic human right and value that must be respected in all areas - including in the workplace. Since these are often violated, the purpose of this writing is awareness of individuals to protect their rights and lesson to employer to guard against the consequences brought about by the abuse of the right to dignity in the workplace. With the development of society, increasing competition among enterprises and battle to enforce markets often result in stress situations or pressures on the working force. Frequently this result in a rivalry between employees. Fight for position can also lead to insinuations, threats and causing fear, which affects the dignity of the individual. Violation of dignity in the workplace has many expressions in domestic and foreign terminology, but it always comes to violence. In this work we present the causes that have given rise to interventions in dignity in the workplace and recognize violations that accompany such interventions. Implementation of mobbing is a systematic process with the aim to oust a member of the working environment, so we also introduced its dynamics. The main purpose of the study is to present topics of worker protection and the role of entities that in such protection should be included. In curbing the problem preventive action awareness and action is the most important. When mobbing recognized, it is not only the problem of the victims, but becomes a problem of the entire organization, society and the state. To this end, we have introduced the role of victims, co-workers, employers, other associations and government policies. With the introduction of case law in Slovenia, we wanted to highlight the importance of knowledge of the systematic problem solving, which is a vital understanding of the legislation. Sadly, Slovenia still ranks among the countries where violation of dignity in the workplace is increasing, so we have to compare the presented protection of these rights in other European countries. The aim of writing is to raise awareness of individuals, organizations and the presentation of the effects of the deployment of state policy to stricter control. The existence of the problem brings serious consequences, because it destroys the rule of law, a healthy society, empty funder, reduces social welfare, reduces business productivity, undermines family relationships and is disrupting the physical and mental state of the individual.
