Title:Varstvo človekovih pravic na Kosovu : magistrsko delo

Abstract:Človekove pravice, medsebojno povezane in odvisne ter nedeljive, naj bi človeku pripadale že po njegovi naravi - vsak posameznik naj bi jih samodejno pridobil že ob rojstvu. Pripadajo vsakemu človeku, omogočiti in ustrezno zavarovati pa mu jih mora država. Vsesplošno priznana pravica, ki izhaja prav iz splošnih človekovih pravic, je pravica do varstva človekovih pravic.Na Kosovu varstvo človekovih pravic počasi napreduje. Parlament je med drugim le sprejel potrebne zakonske spremembe za vzpostavitev posebnega sodišča, ki bo raziskovalo obtožbe o hudih vojnih zločinih(čaka se končna odobritev nizozemskega parlamenta). Kosovo je doseglo majhen napredek pri programih vključevanja povečanega števila Romov, Aškalov in Egipčanov, ki so bili prisilno izgnani iz Nemčije in drugih evropskih držav. Z grožnjami in ustrahovanji se soočajo novinarji, pregoni teh kaznivih dejanj pa so počasni. Še naprej ostajajo napetosti med Srbi in kosovskimi Albanci. Velika težava je tudi nasilje v družini. Število pritožb pri instituciji ombudsmana se je leta 2016 glede na predhodno leto sicer zmanjšalo. Institucija ombudsmana Kosova dobi največ pritožb glede pravice do poštenega in nepristranskega sojenja, najbolj odzivni na pisma ombudsmana Kosova pa so misija EULEX, ministrstvo za pravosodje, Center za socialno delo v Prištini, vladna komisija za preverjanje statusa vojnih veteranov in invalidov,občina Đakovica in Univerzitetni klinični center Kosova. Ustavno sodišče kot zadnji organ ustavnega reda Kosova s svojim delovanjem veliko pripomore h graditvi demokratične družbe na Kosovu, ki temelji na vladavini prava, spoštovanju človekovih pravic in temeljnih svoboščin ter spoštovanju načela delitve oblasti.

Abstract:Human rights -interconnected, interdependent and indivisible - belong by their nature to all human beings. Every individual should automatically obtain them at birth. While human rights belong to every human being, it is the duty of the state to enable and safeguard them appropriately. One universally acknowledged right deriving from general human rights is the right to the protection of human rights. In Kosovo the protection of human rights is advancing slowly. Parliament has, among other things, adopted the necessary statutory amendments for the establishment of a special court to investigate accusations of serious war crimes (currently awaiting final approval from the Dutch parliament). Kosovo has so far achieved little progress in programmes designed to integrate the increased number of Roma, Ashkali and Balkan Egyptians (Jevgits or Jevgs) expelled from Germany and other European countries. Journalists are facing threats and intimidation, and prosecutions of these criminal offences are slow. Tensions remain between Serbs and Kosovo Albanians. Domestic violence is also a major problem. The number of complaints to the ombudsman's office did, however, fall in 2016 compared to the previous year. The largest number of complaints received by the Kosovo ombudsman's office relate to the right to a fair and impartial trial. The institutions that are most responsive to letters from the Kosovo ombudsman are the EULEX mission, the Ministry of Justice, the Social Services Centre in Pristina, the government commission responsible for verifying the status of war veterans and disabled, the municipality of Gjakova and the Kosovo University Medical Centre. The work of the Constitutional Court, as the final authority of the constitutional order of Kosovo, contributes a great deal to the construction of a democratic society in Kosovo based on therule of law, respect for human rights and fundamental freedoms, and respect for the principle of separation of powers.
