Title:Ali lahko podpisnica arbitražnega sporazuma enostransko odstopi od arbitražnega postopka? : magistrsko delo

Abstract:Magistrsko delo na podlagi teoretičnih meril domačih in tujih avtorjev predstavlja mirne načine reševanja sporov, v sklopu katerih podrobneje osvetli pojem mednarodne arbitraže. Bistvo arbitraže, ki jo številni avtorji imenujejo tudi razsodništvo, temelji izključno na podlagi pristanka strank z namenom, da se s tem načinom razreši njihov spor. S predhodnim medsebojnim dogovorom oziroma pristankom na arbitražo se stranke zavežejo k izvršitvi razsodbe arbitražnega sodišča v celoti in v dobri veri. Zato je arbitražna odločba, ki je dosežena z uporabo,prva, po svojem bistvu sodba. Soglasje strank (mednarodnih subjektov), da se nek obstoječi spor med njimi razreši na podlagi arbitraže, pa se izrazi kot mednarodna pogodba. Ne glede na vse pravne teorije in konvencije, ki stranke podpisnice arbitražne pogodbe zavezujejo k spoštovanju poprej naštetih določil, pa se v praksi dogaja, da se pravnih norm podpisnic arbitražnega sporazuma ne spoštuje oziroma se z različnimi pravnimi prazninami poskuša najti pot, ki že sprejete in ratificirane zaveze postavlja na glavo. Zasledovani cilj temelji na oceni morebitnih pravnih lukenj in pravnih posledic v konkretnem primeru v arbitražnem postopku med Slovenijo in Hrvaško po enostranskem odstopu od pogodbe Hrvaške. Delo proučuje tudi pravne možnosti v trenutni situaciji obeh držav podpisnic in glede na pravna merila predvideva končni razplet.

Abstract:The master's thesis based on the theoretical criteria of domestic and foreign authors presents peaceful ways of resolving disputes in which the concept of international arbitration is elaborated. The essence of arbitration is based exclusively on the basis of the parties' consent, with a view to resolving their dispute with this method. By prior mutual agreement or arbitration, the parties undertake to enforce the arbitral tribunal's judgment in full and in good faith. Consequently, an arbitration award is, in essence, a judgment which is achieved by the application of the law. Consent of parties (international entities) that an existing dispute between them will be resolved on the basis of arbitration shall be expressed as an international treaty. Notwithstanding all the legal theories and conventions which bind the parties to the arbitration agreement to comply with the aforementioned provisions, in practice it happens that the legal norms of the parties to the arbitration agreement are not respected, or, with various legal vacuums, try to find a way that already Accepts and ratifies the commitments. The aim pursued is based on the assessment of possible legal holes and legal consequences in a particular case in the arbitration procedure between Slovenia and Croatia following a unilateral withdrawal from the contract of Croatia. It also examines the legal options in the current situation of the two signatory states and, according to legal criteria, provides for a final outcome.
