Abstract:Ob vsem napredku medicine še vedno nimamo zdravil in pripomočkov, s katerimi bi lahko pomagali vsakemu bolniku, vemo pa, da lahko s presaditvijo organov in tkiv povrnemo zdravje, včasih celo življenje tistim, ki jih brez presaditve le-teh zagotovo čaka smrt. Danes je transplantacijska dejavnost v svetu in pri nas splošno sprejeta oblika zdravljenja, pri katerem gre za prenos živih celic, tkiv in organov enega osebka drugemu osebku ali tudi iz enega dela telesa v drugega, da bi se vzpostavila izpadla funkcija. Čeprav je transplantacija splošno sprejeta in razširjena oblika zdravljenja, s seboj ni prinesla le pozitivnih posledic. Narava transplantacije je namreč takšna, da se na tem področju srečujemo s številnimi vprašanji. Vsekakor je najpomembnejše vprašanje, kako zagotoviti ustrezne organe za presajanje. V zvezi s tem pa se prav tako postavlja vprašanje, pod kakšnimi pogoji je odvzem človeškega telesa etično sprejemljiv in pravno dopusten. Področje transplantacije se dotika področja osebnostnih pravic oziroma varstva nedotakljivosti posameznikove integritete, tako telesne kot duševne, in spoštovanja njegovega dostojanstva. Zato se je z razvojem transplantacije pojavila težnja in hkrati nuja, da se to področje kar se da natančno pravno uredi ter s tem zavaruje subjekte transplantacije pred možnimi zlorabami in hkrati ne zavre nadaljnjega medicinskega razvoja. S pravnega vidika je bilo potrebno pravno urediti tako ureditev in organizacijo javnega zdravstva kot tudi formalno izpolnjevanje vseh potrebnih pogojev, da se transplantacija lahko opravi. Izjemnost transplantacijske dejavnosti ni samo v tehnološkem ter medicinskem napredku, ki povzroči, da je potrebno pravno ureditev tega področja nenehoma prilagajati, ampak tudi v tem, da je potrebno za celostno predstavo te tematike upoštevati tudi kulturnoantropološki pogled na transplantacijsko dejavnost.

Abstract:Despite the major advances in medicine, the existing medical products and devices do not suffice to help each and every patient. However, organ and tissue transplant is known to help patients recover, or even save lives of those who would otherwise succumb. At the global and Slovenian level, transplantation is nowadays a widely established type of therapy involving transfer of live cells, tissues and organs from one individual to another, or from one part of the body to another, in order to compensate for the lost function.Even though transplantation therapy is generally accepted and widely used, its consequences are not just positive. The nature of transplantation raises many questions, the most important being how to provide appropriate organs to be transplanted. In this regard, the question arises under which conditions it is ethically acceptable and legally permissible to collect a part of a human body.The area of transplantation medicine touches the field of personality rights, the protection of inviolability of personal integrity, both physical and mental, and the respect of personal dignity. Thus, the development of transplantation medicine has led to a tendency and a necessity for legal regulation in order to protect transplant subjects against potential abuse, while not obstructing further medical progress. From the legal point of view, legal regulation and organisation of public health as well as formal fulfilment of the required conditions for performing a transplant were necessary.The exceptional character of transplantation lies not only in the technological and medical advances that require continuous adaptation of the legal regulation of this field, but also in the fact that cultural and anthropological aspects need to be considered in order to obtain a comprehensive overview of the subject.
