Title:Vloga pogajanj znotraj diplomatskih sredstev mirnega reševanja sporov : diplomsko delo

Abstract:V mednarodnem pravu imajo države in drugi subjekti mednarodnega prava na voljo izbiro sredstev in uporabo različnih metod za reševanje sporov. Načeloma je izbira sredstev mirnega reševanja sporov odvisna od narave zadevnega spora. V teoriji in praksi delimo spore na pravne in politične. Dolžnost mirnega reševanja mednarodnih sporov predstavlja eno izmed temeljnih mednarodnopravnih načel in glede na naravo področja temelji predvsem na logiki kompromisa.Nabor diplomatskih sredstev mirnega reševanja mednarodnih sporov nam omenja 33. člen Ustanovne listine Organizacije združenih narodov, ki poleg obeh pravnih sredstev navaja naslednja tipična diplomatska sredstva: pogajanja, preiskavo (anketo), posredovanje in spravo (konciliacijo). V nadaljevanju je diplomsko delo osredotočeno na diplomatska sredstva, ki se odražajo kot posebej fleksibilna zaradi nevezanosti na formalni pravni okvir in zlasti, ker je strankam v sporu dopuščena možnost izbire drugih vrst oziroma načinov mirnega reševanja mednarodnih sporov ter medsebojne kombinacije. Temeljna in najpogostejša metoda reševanja sporov so pogajanja. Pogajanja so uporabna pri sporih različne narave in so navadno, vendar ne nujno, prvo sredstvo mirnega reševanja sporov, ki ga stranki izbereta za rešitev konkretnega mednarodnega spora.

Abstract:In international law, countries and other subjects of international law may choose the means and utilise various methods of dispute resolution. In principle, the choice of means of amicable dispute resolution depends on the nature of the dispute in question. In theory and in practice, we differentiate legal and political disputes. The obligation to resolve international disputes in an amicable manner represents one of the fundamental principles of international law and considering the nature of the field, such an obligation is based mainly on the logic of compromise. The large set of diplomatic means of amicable resolution of international disputes is mentioned in Article 33 of the United Nations Charter, which states, in addition to both legal remedies, the following typical diplomatic means: negotiations, research (survey), intervention and reconciliation (conciliation). In the following, the thesis is more focused on diplomatic means, which are proven to be particularly flexible due to not being bound to the formal legal framework and especially because the parties in the dispute may choose other types ormethods of amicable resolution of international disputes and the combination of all of them. The fundamental and the most frequent method of dispute resolution are negotiations. Negotiations are useful in disputes of different kinds and are usually, but not necessarily, the first means of amicable dispute resolution, which the parties choose for the resolution of the particular international dispute.
