Title:Vloga uredbe GDPR (EU) 2016/679 pri varstvu osebnih podatkov v delovnem razmerju : diplomsko delo

Abstract:Nova evropska uredba GDPR (EU) 2016/679 je z letošnjim letom uvedla nekaj ključnih novosti na področju varovanja osebnih podatkov, na katere morajo biti delodajalci pri upravljanju z osebnimi podatki svojih zaposlenih posebej pozorni. V slovenskem pravnem reduje bilo to področje do zdaj urejeno področno v več zakonih. Sprejet je bil predlog novega ZVOP-2, vendar sam zakon še ni bil sprejet, zato se z začetkom veljavnosti Splošne uredbe EU o varstvu osebnih podatkov ta v primerih kolizije uporablja neposredno. Splošna načela upravljanja z osebnimi podatki zaposlenih tudi z novo uredbo ostajajo enaka, dodano je načelo odgovornosti, na podlagi katerega na delodajalcu leži dokazno breme v zvezi z varstvom osebnih podatkov zaposlenih. Splošna uredba EU je z določenimi ukrepi, na primer uvedbo pooblaščene osebe za varstvo osebnih podatkov, predhodnega posvetovanja z nadzornim organom, oceno učinka v zvezi z varstvom osebnih podatkov in obvestila o kršitvi varstva osebnih podatkov, še dodatno okrepila sistem varovanja osebnih podatkov zaposlenih.V diplomski nalogi na podlagi trenutno veljavne zakonodaje in strokovne literature analiziram slovensko pravno ureditev področja varovanja osebnih podatkov zaposlenih in novo evropsko uredbo na tem področju. Ugotavljam, da se ureditev bistveno ne spreminja. Uvaja pa nova uredba dodatna varovala, ki bodo pozitivno vplivala na sprejemanje še boljših varnostnih odločitev delodajalcev in posledično zmanjšala kršitve na tem področju.

Abstract:The new European General Data Protection Regulation (EU) 2016/679, also known as GDPR, has introduced some key novelties in the field of personal data protection, which employers need to pay special attention to while managing the personal data of their employees. In the Slovenian legal system, this area was previously regulated by several laws. Recently a proposal for a new act ZVOP-2 was adopted, but since the act has not been adopted yet, GDPR shall apply directly in case of conflict. The general principles of the management of employees' personal data remain the same with the new regulation; however, the principle of liability has been added, based on which the burden of proof shall lie with the employer. With certain measures, for example designation of the data protection officer, prior consultation with the supervisory authority, data protection impact assessment and notification of a personal data breach, GDPR has further strengthened the system for protecting the personal data of employees. This thesis analyzes Slovenian legal regulation of the protection of the personal data of employees based on Slovenian legal system and expert opinions, and the new European regulation in this field. The legal regulation and general principles of data processing have not changed significantly with GDPR. However, the new regulation has introduced additional safeguards that will have a positive impact on employers, improving their protection of personal data, and consequently reducing violations in this area.
