Title:Predstavitev in analize sodbe ustavnega sodišča Republike Slovenije v zadevi "Patria" : diplomsko delo

Abstract:Zadeva "Patria" je verjetno najbolj odmeven proces od osamosvojitve Slovenije. Za laično javnost predvsem zaradi obtoženega in kasneje tudi obsojenega prvaka takratne opozicije Janeza Janše, za strokovnjake pa predvsem zaradi njene vsebine in vpliva na takratne volitve in tako tudi na samodemokracijoin pravno državo v Sloveniji. Ustavno sodišče je organ sodne veje oblasti, ki se hierarhično nahaja najvišje v smislu varovanja človekovih pravic in temeljnih svoboščin in pri varovanju ustavnosti in zakonitosti.Položaj ustavnega sodišča določa Ustava, njegovo delovanje in pristojnosti pa bolj podrobno ureja Zakon o ustavnem sodišču (ZUstS). Poslovanje sodišča je urejeno s poslovnikom. Osebe, ki mislijo, da jim je bila kršena kakšna človekova pravica ali temeljna svoboščina, imajo na voljo posebno pravno sredstvo, ki jim omogoča, da o tem, ali jim je bila dejansko kršena katera izmed človekovih pravic in temeljnih svoboščin, odloča Ustavno sodišče. To pravno sredstvo se imenuje ustavna pritožba. Ustavno sodišče zato nosi veliko odgovornost pri izdajanju sodb, saj vsaka sodba, ki jo sodišče izda, postane precedens, ki soustvarja sodno prakso. Pri tako občutljivih zadevah, kot je bila zadeva "Patria", pa je odgovornost in potreba po previdnosti Ustavnega sodišča pri izdaji sodbe še toliko večja. Ustavno sodišče je dne 20.04.2015 izdalo tri odločbe (Up-879/14, Up-883/14, Up-889/14), s katerimi je razveljavilo vse sodbe izdane od Vrhovnega do Okrajnega sodišča v zadevi "Patria" in zadeve dodelilo drugemu sodniku Okrajnega sodišča v Ljubljani v novo odločanje.

Title:Predstavitev in analize sodbe ustavnega sodišča Republike Slovenije v zadevi Patria
Abstract:The "Patria" case is probably the most media covered case in Slovenia since country's independence. For the lay public, the case was interesting mostly because of the defendant and also convict -Janez Janša, the ex prime minister and later the serious rival in the parliamentary opposition. For the experts, the case was interesting because of its content and its impact on the elections of the time, on the rule of law and on democracy itself.Constitutional Court is the highest body of the judicial branch of power for the protection of the human rights and fundamental freedoms and for protection of constitutionality and legality. The position of the Constitutional Court is regulated by the Constitution, its operation and powers are regulated in more detail by the Constitutional Court Act (ZUstS). Work of the Court is regulated by the Rules of Procedure. For those who believe that any of their human rights or fundamental freedoms were violated, there is a special legal remedy available,which enables the Constitutional Court to decide whether the human right or fundamental freedom was violated or not. This legal remedy is constitutional complaint.Constitutional Court carries a great responsibility because every judgment which the Constitutional Court issues becomes precedent which co-creates case-law. Responsibility and cautionwhen issuing judgments are larger when it comes to very sensitive cases, like the "Patria" case was.The Constitutional Court issued three decisions on 20.04.2015 (Up-879/14, Up-883/14, Up-889/14) which have invalidated all the judgments from the Supreme Court to the District Court in the "Patria" case and assigned the issues to another judge at the District Court in Ljubljana for a new trial.
