Abstract:Pravna država je tista, ki ne krši človekovih pravic in svoboščin, vendar je za zagotovitev varnosti in reda prisiljena poseči v to delikatno področje. Vsaka pravna država ima natančno predpisane postopke, da bi bili posegi v človekove pravice in svoboščine v skladu z načelom zakonitosti, zatorej moramo še posebej paziti, da so ti prijemi in sredstva v skladu s človečnostjo in humanostjo. Država mora vedno in povsod paziti na svoje državljane ne glede nato, ali spoštujejo njen pravni red ali ne. Kršenje zakonodaje ne sme biti nikoli vzrok za prekomeren poseg v človekove pravice. Vsi si zaslužijo obravnavo v skladu s predpisano zakonodajo in na način, da se ne krši njihove človečnosti in dostojanstva ter se z njimi ravna na dostojen in human način. Moja končna misel je, da se za nastanek nezaželenih posledic uporabe prisilnih sredstev veliko preveč poudarja in prelaga odgovornost na državo, vendar mora država zagotoviti zakonite pogoje in zakonito izvajanje pooblastil.

Abstract:The state governed by the rule of law is a state which does not infringe human rights and freedoms. In order to provide safety and order, it may however beforced to deal with this delicate subject. Each state governed by the rule of law has prescribed procedures which ensure that encroachments of human rights and freedoms are in accordance with the principle of legality. Therefore, we have to take special care that these approaches and measures are in accordance with humanity. The state shall always take care of its citizens regardless of whether they observe its acquis or not. Law infringements shall never be the reason for excessive encroachment of human rights. Everybody deserves treatment that is consistent with prescribed legislation, in a manner which does not violate their humanity and dignity, and to be handled in a decent and human way.In conclusion, I believe that the state is all too often mentioned in association with the undesirable implications related to the use of coercive measures, and blamed for them. Yet, the responsibility of the state is to provide legal conditions and legal exercise of implementing powers. It depends on an individual, however, whether these powers will be exercised on him/her or not.
