Title:Uporaba brezpilotnih letalnikov in zasebnost : magistrsko delo

Abstract:Moderna doba je s hitrim tehnološkim razvojem zelo razširila uporabo brezpilotnih letalnikov. Njihova uporaba se je postopoma s prvotnega obrambno-varnostnega področja razširila na civilno-komercialno področje. Brezpilotni letalniki namreč pripomorejo k učinkovitosti določenih opravil in dejavnosti, s čimer razbremenijo človeka. Na drugi strani pa prinaša njihova uporaba številna tveganja in nevarnosti, ki pomenijo poseg v ustavno zagotovljeno pravico do prostorske, komunikacijske in informacijske zasebnosti. Uporaba brezpilotnih letalnikov mora biti zato ustrezno normativno urejena in mora ustrezati ustavnopravnim standardom varstva zasebnosti. Na relaciji ukrepa in cilja je tako treba pretehtati in poiskati pravo sorazmerje med varnostjo državljanov na eni strani in človekovo pravico do zasebnosti na drugi strani. Zato je pomembno, da se pri analiziranju veljavnih predpisov sledi načelu sorazmernosti, opravi test legitimnosti in v nadaljevanju strogi test sorazmernosti, ki pokaže pravo sorazmerje in potrdi ali pa ovrže ustavno dopustnost posegov v pravico do zasebnosti. Za doseganje in učinkovito zagotavljanje splošne varnosti ljudi in premoženja lahko policija pri opravljanju določenih nalog uporablja brezpilotne letalnike. Vsak poseg v zasebnost pa je lahko le tolikšen, da se zagotovi pričakovana stopnja varnosti.

Abstract:With a fast technological development, the use of unmanned aerial vehicles has spread significantly inthe modern age. Their use has gradually expanded from the initial field of security and defenceto the civil and commercial field, since it increases the efficiency of certain works and activities, and relieves the human factor. On the other hand, it also creates several risks and hazards that interfere with the constitutional right to spatial, communication and information privacy. The use of unmanned aerial vehicles should therefore be adequately regulated and meet the constitutional standards of protection of privacy. Regarding the measures and the objectives, the right proportion between the security of citizens on one hand and the human right to privacy on the otherneeds to be considered. Therefore, in analysing the applicable regulations the principle of proportionality needs to be followed, a legitimacy test performed and after that a strict proportionality test which indicates the right proportion and confirms or refutesthe constitutional permissibility of interference with the right to privacy. To achieve and effectively guarantee the overall safety of persons and property, the police can use unmanned aerial vehicles in performing specific tasks. Every interference with privacy can only be such that the expected rate of security is ensured.
