Title:Učinkovitost mednarodnega kazenskega sodišča za vojne zločine na območju nekdanje Jugoslavije (ICTY) v primeru sojenja zaradi zločinov v Srebrenici : diplomsko delo

Abstract:V diplomskem delu obravnavam vprašanje (ne)učinkovitosti delovanja Mednarodnega kazenskega sodišča za nekdanjo Jugoslavijo (ICTY) pri sojenju odgovornim za vojne zločine, storjene v mestu Srebrenica. Ti hudi zločini - med njimi genocid približno 8000 Bošnjakov - so odmevali v celotni mednarodni skupnosti. Sodišče je od svoje ustanovitve leta 1993 do konca svojega obstoja leta 2017 obravnavalo obtožnice zoper 161 vojaških in političnih vodij, dvajset izmed njih obtoženih za zločine v Srebrenici. V petindvajsetih letih svojega delovanja je ICTY sprožilo številne polemike v javnosti; nekateri poudarjajo njegove uspehe in dosežke, drugi kritizirajo njegove pomanjkljivosti. V nalogi so predstavljeni ključni podatki o postopkih zoper obtožene, čemur sledi predstavitev izhodišč za oceno delovanja ICTY, ki aktualizirajo temeljne cilje delovanja Sodišča: zagotavljanje pravičnosti, preprečevanje nadaljnjih kaznivih dejanj ter obnova in ohranjanje miru v državah nekdanje Jugoslavije. Na podlagi analize različnih mnenj, objavljenih v strokovni literaturi, predstavim razlike v pogledih na dosežke in pomanjkljivosti pri delovanju te mednarodnopravne institucije v primeru sojenja za zločine v Srebrenici ter analiziram učinkovitost Sodišča ter ključne dejavnike njegove (ne)učinkovitosti.

Abstract:My Bachelor's Thesis examines the issue of the (in)effectiveness of the operation of the International Criminal Tribunal for the former Yugoslavia (ICTY) in the trials against perpetrators of war crimes committed in the town of Srebrenica, Bosnia & Herzegovina. These serious crimes - including the genocide against some 8,000 Bosniaks - have widely echoed throughout the entire international community. Since its foundation in 1993 until the end of its existence in 2017, the Court dealt with indictments against 161 military and political leaders, twenty of them indicted for crimes in Srebrenica. During the twenty-five years of its operation, the ICTY has sparked a number of public controversies, some emphasising its successes and achievements, others criticising its shortcomings. Basic data on the proceedings against the accused are presented, followed by the preliminaries for an assessment of ICTY's operation that refer to its major objectives: ensuring justice, preventing further crimes, and restoring and preserving peace in the countries of the former Yugoslavia. Based on the analysis of diverse opinions published in professional literature, I present the main differences in views on the achievements and deficiencies in the functioning of this international law institution in the case of the Srebrenica war crimes trials, and analyse the effectiveness of the Court and key factors of its (in)effectiveness.
