Title:Preživnine v Sloveniji : diplomsko delo

Abstract:Preživnina je eden najpomembnejših pojmov družinskega prava, je zahteva pravičnega in etičnega odnosa do bližnjega. Temelji na načelu vzajemne pomoči in družinske solidarnosti. Izraz preživnina pomeni denarni znesek,namenjen preživljanju. Logična posledica razveze zakonske zveze ali zunajzakonske skupnosti je preživljanje otroka ali bivšega zakonca. Preživnina se določi v mesečnem znesku za naprej od trenutka vložitve tožbe. Oseba, ki je pravno zavezana k preživnini, jo je dolžna plačevati v denarni obliki. Seveda pa vsi zavezanci svoje obveznosti ne izpolnjujejo, zato imajo upravičenci do preživnine pravico do nadomestila. Z rastjo cen življenjskih potrebščin se enkrat letno uskladi tudi višina preživnine. Višina preživnin se določa s pomočjo centrov za socialno delo in stvarno pristojnih sodišč na prvi stopnji. Prav tako se višina preživnine določi z dogovorom med staršema, slediti je treba koristi upravičenca. Preživnina se določa individualno, z upoštevanjem okoliščin primera, kamor spadajo potrebe upravičenca ter materialne zmožnosti in sposobnosti zavezanca. S preživnino se zagotavljajo primerne življenjske razmere upravičenca. Preživljanje je osebna pravica in dolžnost, ki se ne prenaša na druge osebe in se ne deduje. Pravici do preživnine se ne moremo odpovedati.

Abstract:Financial support is one of the most important concepts in family law and a prerequisite to fair and ethical relations with a relative. It is based on the principle of mutual assistance and family solidarity. The term financial support refers to money dedicated to financially support a person. A divorce or a separation leads to one person paying financial support for their child or former spouse. The monthly financial support is determined in advance, from the date of filing the application. Anyone who is legally liable to pay the financial support must do so in cash. However, not everyone who is liable to pay financial support tend to fulfil their obligations, so the beneficiaries are entitled to a compensation. The amount of financial support is aligned once a year in accordance with the rise in consumer prices. The amount of a financial support is determined by a social work centre and a competent court of first instance. Furthermore, the financial support must be determined by agreement between the parents, taking into consideration the benefits of the beneficiary. The financial support is determined on an individual basis, taking into account the circumstances of a particular case, which include the needs of the beneficiary and the material position of the person who is liable to pay the support. The financial support is intended to provide adequate living conditions for the beneficiary. Financial support is an individual's right and obligation, which cannot be inherited or transferred to another person. Nobody can give up the right to financial support.
