Title:Pravni postopki izvedenca za slikovno gradivo, fotografijo in video na področju civilnega, gospodarskega, delovno-socialnega in kazenskega prava : magistrsko delo

Abstract:Izvedenca na področju slikovnega gradiva, fotografije in videa se razumeva kot znanstveno osebo (izvedenec kot iudex facti), ki v sklopu svojih znanj in dognanj ter stalnega izobraževanja, na podlagi imenovanja,postane sodnikov pomočnik (bonus instructor iudicis). Izvedeništvo je samostojno dokazno sredstvo, ki velja za posebno dokazno sredstvo. Delo sodnega izvedenca urejata Zakon o sodiščih (ZS) in Pravilnik o sodnih izvedencih in sodnih cenilcih. Za imenovanje sodnega izvedenca iz področja slikovnega gradiva, fotografije in videa, je potrebno izpolnjevati pogoje iz 87. člena ZS, izkazati poznavanje pravnih vsebin in posebna strokovna znanja, predpisana v sklopu izobraževalnih vsebin posameznega področja za sodne izvedence, sodne cenilce in tolmače. Dokazna vrednost slikovnega gradiva, fotografije in videa se v posameznih pravnih postopkih obravnava glede na način pridobitve in izvedbe dokazovanja. Zato je zelo pomembno, da ima sodni izvedenec formalno pridobljeno strokovno znanje in izkušnje s področja slikovnega gradiva, fotografije in videa. Za njegovo imenovanje pa je pomembna tudi ustrezna izpeljava preizkusa strokovnih znanj. Vsi ti elementi so podlaga za kvalitetno izpeljan izvid (visum repertum) in strokovno, na laičen način, napisano mnenje (parere).Ugotovitve na podlagi zbranih razpoložljivih podatkov o ustreznosti postopka imenovanja in zahtevanega strokovnega znanja ter izkazanih potreb po sodnem izvedencu za področje slikovnega gradiva, fotografije in videa v sodnih postopkih so podane v zaključku naloge.

Abstract:An expert on images, photography and video is a scientist (an expert as iudex facti) who is appointed as the judge's assistant (bonus instructor iudicis) on the basis of his knowledge, skills and constant education. Expert service serves as independent evidence, applicable to special evidence. The work of a court expert is governed by the Courts Act (ZS) and the Rules on Court Experts and Certified Appraisers. In order to be appointed asacourt expert in the field of images, photography and video, one must meet the conditions as set out in Article 87 of ZS, show understanding of legal content and possess special expert knowledge as prescribed within the educational content in a specific area for court experts, certified appraisers and interpreters.The proven value of images, photography and video is treated in specific legal procedures asthe basis of the means of acquiring and presenting evidence. Therefore, it is very important that the court expert has formal professional knowledge and experience in the area of images, photography and video. In order to be appointed, one must also pass a relevant exam of professional skills. All these elements serve as the basis for a qualitative report (visum repertum) and a professional expert opinion (parere) written in lay terms. The findings on the basis of collected available data on the adequacy of the appointment process and the required professional skills and demonstrated needs for a court expert in the field of images, photography and video in court procedures are set out in the conclusion of the assignment.
