Title:Razdelitev premoženja pri razvezi v zakonski in zunajzakonski skupnosti : diplomsko delo

Abstract:Vse hitrejši tempo in "svobodna miselnost" sta pripeljala do vse večjega števila razvez zakonske zveze in zagotovo tudi razpada zunajzakonske skupnosti.Zakon ureja tako sklenitev in razvezo zakonske zveze kot določila, kdaj postane zunajzakonska skupnost pravno izenačena z zakonsko zvezo. Zakonska zveza je namreč opredeljena kot "življenjska skupnost moža in žene", zunajzakonska skupnost pa kot "skupnost moškega in ženske, ki nista sklenila zakonske zveze". Eno od področij, ki ga morata partnerja urediti in bo imelo velik vplivna prihodnost vsakega izmed njiju, je zagotovo premoženje. V sklop zakonskega urejanja premoženja spada preživljanje razvezanega zakonca, vračanje daril, delitev skupnega premoženja, priimek zakoncev in stanovanje razvezanega zakonca. Ob razhodu imata partnerja možnost, da se sama dogovorita in razdelita skupno premoženje, torej gre za sporazumno ločitev. V primeru, da sama dogovora ne moreta doseči, eden od zakoncev vloži tožbo in tako sproži postopek,v katerem sodišče določi razdelitev premoženja.

Abstract:An ever-faster pace and "free mindset" have led to an increasing number of divorces and certainly breaks up in common-law relationships. The law regulates both, the conclusion and the divorce, and is setting the rule when the common-law relationships become legally equal with the marrige. The marrige is defined as a "union between a man and a woman", meanwhile the common-law relationship is defined as a "two unmarried persons living together as though married ". One of the area that the partners have to regulate in case of the seperation and will have a major impact on their future is certainly the property. The branch of the regulations of property includes the maintenance ofa divorced spouse, the return of gifts, the sharing of the joint property, the surname of the spouses and the apartment of a divorced spouse. At the end of the relationship, the partners may be able to agree on how the marital property will be divided, that is called uncontested divorce. If they will not be able to reach a settlement, one of the spouses will have to file for divorce and the court will make the final decision on all issued they were not able to negotiate.
