Title:Pritožba v upravnem sporu : diplomsko delo

Abstract:Vsebina diplomske naloge se nanaša na pravico do pritožbe v upravnem sporu, ki jo zagotavlja že Ustava, zato mora biti ustrezno urejena tudi v postopku upravnega spora. Glede na ostale sodne postopke je omejena zaradi specifičnosti postopka, ki se začne že pred upravnim organom v postopku izdaje upravnega akta. Pri upravnem sporu gre za sodno kontrolo nad zakonitostjo delovanja uprave, s katero se varujejo pravice in pravni interesi posameznikov in pravnih oseb. V okviru upravnega spora sodniki, ki so vezani samo na Ustavo in zakon, odločajo o zakonitosti in pravilnosti aktov, izdanih s strani državnih organov, organov lokalnih skupnosti in nosilcev javnih pooblastil. Zakon, ki ureja postopek upravnega spora, je Zakon o upravnem sporu (ZUS-1), ki je bil sprejet leta 2006 z začetkom veljave leta 2007. V njem so urejena tudi pravna sredstva, ki so na voljo strankam upravnega spora.O pritožbi nad sodno odločbo prve stopnje odloča Vrhovno sodišče Republike Slovenije.Poleg pritožbe je zoper odločitev Upravnega sodišča mogoče vložiti tudi revizijo, ki pa je za razliko od pritožbe izredno pravno sredstvo. O reviziji je prav tako pristojno odločati Vrhovno sodišče. Od sprejetja novele Zakona o pravdnem postopku (ZPP-E) je revizija tudi v upravnem sporu urejena nekoliko drugače. Namen naloge je predstaviti institut pritožbe v procesu upravnega spora in ugotoviti, če ustreza merilom pravnega sredstva iz Ustave.

Abstract:The content of the thesis relates to the right to an appeal in an administrative dispute, which is guaranteed by the Constitution, and therefore must be properly regulated in the administrative dispute act. In view of other judicial procedures it is however limited due to the specificity of the procedure, which begins before the administrative body in the issuing procedure of an administrative act. In the context of an administrative dispute the legality of the functioning of the administration, protecting the rights and legal interests of individuals and legal entities, is a matter of judicial review. Within the framework of an administrative dispute, judges, bound only by the Constitution and the law, decide on the legality and regularity of acts issued by state bodies, local community bodies and holders of public authority. The Act regulating the administrative dispute is the Administrative Dispute Act (ZUS-1), which was adopted in 2006 and came into force in 2007. It includes the legal remedies regulations, which are available to the parties of the administrative dispute. The Supreme Court of the Republic of Slovenia decides on the appeal of a first instance court decision. In addition to the appeal,a revision may also be filed against the decision of the administrative court, which, unlike an appeal, is an extraordinary legal remedy. The Supreme Court is also competent to decide on the revision. Since the adoption of the amendment to the Code of Civil Procedure (ZPP-E), the revision was also slightly regulated in the administrative dispute.
