Title:Dedovanje tujcev - čezmejno dedovanje : magistrsko delo

Abstract:S prostim pretokom oseb znotraj držav članic Evropske unije se število dedovanj s čezmejnim elementom iz dneva v dan povečuje. Na eni strani lahko govorimo o državi dejanskega prebivališča, na drugi strani o matični državi oziroma državi izvora. Ena izmed posledic migracij znotraj Evropske unije je nedvomno tudi dedovanje, ki pa je bilo zaradi različnih nacionalnih ureditev dednega prava v vsaki državi članici močno oteženo. Na ravni Evropske unije je bilo zato nujno treba sprejeti resolucijo, ki bi tovrstne ovire, če žene v celoti odpravila, pa vsaj močno zmanjšala.Ta resolucija bi bila v pomoč ne samo sodiščem ali drugim pristojnim organom, temveč tudi vsem državljanom Evropske unije. Navedeni razlogi so privedli do sprejetja Uredbe št. 650/2012 Evropskega parlamenta in Sveta o pristojnosti,pravu, ki se uporablja, priznavanju in izvrševanju odločb in sprejemljivosti in izvrševanju javnih listin v dednih zadevah ter uvedbi evropskega potrdila o dedovanju. Na njenem temelju je bila sprejeta še Izvedbena uredba Komisije (EU) št. 1329/2014 z dne 9. decembra 2014.Skupaj tvorita temeljni dokument, zavezujoč v vseh državah članicah razen v Združenem kraljestvu, na Irskem in Danskem, ki je harmoniziral področje dednega prava in z njim povezane postopke ter uvedel evropsko potrdilo o dedovanju.

Abstract:With the free movement of persons within Member States of the European Union, the number of inheritances with a cross-border element increases day by day. On one hand, we can talk about the country of actual residence, on the other hand, about the home country or country of origin. One of the consequences of migration within the EU is undoubtedly inheritance, which was, due to different national laws governing hereditary law in each of the Member States, greatly hampered. Therefore, it was absolutely necessary to adopt a resolution at EU level, which would, if not in its entirety, at least greatly facilitate such obstacles, not only to the courts or other competent authorities, but also to all EU citizens. All these reasons led to the adoption of Regulation No. 650/2012 of the European Parliament and ofthe Council on jurisdiction, applicable law; recognition and enforcement of decisions and the admissibility and enforcement of authentic instruments in succession matters, and the establishment of a European Certificate of Succession, and on the basis there of, also Commission Implementing Regulation (EU) No. 1329/2014 of 9 December 2014, which together constitute a basic document, binding in all Member States, except in the United Kingdom, Ireland and Denmark, which harmonized the field of inheritance law and procedures related to them, and introduced the European Certificate of Succession.
