Title:Legalizacija evtanazije v Sloveniji : magistrsko delo

Abstract:Magistrsko delo obravnava problematiko legalizacije evtanazije. Namen dela je do-kazati, da je v Sloveniji mogoče posamezniku zagotoviti pravico do lepe in dostojne smrti tudi brez legalizacije evtanazije. V pomoč odgovoru avtorica potrdi hipotezo, da trenutna slovenska ureditev že omogoča posamezniku lepo in dostojno smrt ter me-ni, da si veliko ljudi v Sloveniji želi legalizirati evtanazijo zaradi nepopolnega poznavanja in slabega razumevanja širine tega zahtevnega vprašanja. Prav tako avtorica potrdi hipotezo, da je slovenska ureditev v skladu s pravnimi akti Sveta Evrope in sodbami Evropskega sodišča za človekove pravice in da ima posameznik v Sloveniji na voljo različne alternative, kot so paliativna nega, zdravljenje z dvojnim učinkom, zavrnitev predlaganega medicinskega posega in zdravljenja, institut pacientove vnaprej izražene volje itd., s katerimi je posamezniku zagotovljena lepa in dostojna smrt. Avtorica v svojem delu poudari, da se ne gre zavzemati za legalizacijo evtanazije, ampak je treba predrugačiti pravno razumevanje odgovornosti družbe in države do kakovosti življenja. V tem konkretnem primeru mora država, npr. z usposobljenostjo kadrov, s kakovostjo paliativne nege, z obveščanjem javnosti o pravicah pacientov ter z vzgojo in izobraževanjem mladih seznanjati svoje državljane o vseh alternativah, s katerimi se dosega pravica do lepe in dostojne smrti brez legalizacije evtanazije. Čeprav se državi nalagajo zahtevne naloge, zahtevnost ne sme biti argument za odmikanja od odgovornosti. Še več, država mora stremeti k temu, da stoji ob svojem državljanu tudi ob najtežjih trenutkih, kar vprašanje o lepi in dostojni smrti nedvomno je.

Abstract:This master's thesis deals with the problems of legalizing euthanasia. The purpose of the thesis is to prove that, in Slovenia, it is possible to ensure an individual's right to a graceful and respectable death even without the legalisation of euthanasia. In order to answer this question, the author confirms the hypothesis that current Slovenian regulation already enables a graceful and respectable death and believes that many people in Slovenia wish to legalize euthanasia due to their incomplete knowledge and poor understanding of the whole amplitude of this difficult issue. Furthermore, the author confirms the hypothesis that the Slovenian regulation is in accordance with the Council of the EU legal instruments and with the verdict of The European Court of Human Rights, and that in Slovenia every individual has various alternative options at their disposal, such as palliative care, the doctrine of double effect, rejection of suggested medical procedure and treatment, patient's previously expressed wishes, etc. with which a patient's right to a graceful and respectable death is ensured. The author emphasizes that we should not aim to legalize euthanasia, but rather to change the legal understanding of our society and state's re-sponsibility towards the quality of life. In this particular case, it is with measures such as personnel qualification, quality of palliative care, public informing regarding the patients' rights and upbringing and education of the younger generations, that the state should inform its citizens about all possible alternatives with which the right to a graceful and respectable death is achieved, without the need to legalize euthanasia. Although these tasks are demanding, this should not be an argument to avoid the state's responsibilities. Even more, the state must strive to support its citizens even in their most difficult moments, which the question of a graceful and respectable death indubitably is.
