Title:Nujnost privilegijev in imunitet diplomatskih predstavništev in predstavnikov : diplomsko delo

Abstract:Namen diplomske naloge je ugotoviti nujnost in potrebnost diplomatskih privilegijev in imunitet ter poskušati odgovoriti na vprašanje, ali bi slednje lahko skrčili, omejili ali celo ukinili. V prvem delu diplomske naloge najprej spoznamo pojem diplomacije in njen razvoj. Ugotovimo, da so se diplomatski privilegiji in imunitete pojavili že zelo zgodaj s pojavom prvih civilizacij, se razvijali skozi zgodovino in končno si ogledamo še sodobno kodifikacijo s poudarkom na Dunajski konvenciji o diplomatskih odnosih. Na primerih spoznavamo zlorabo in nespoštovanje diplomatskih privilegijev in imunitet in se sprašujemo, kako zlorabe omejiti. Na podlagi teoretičnih del in praktičnih primerov sklenem, da je kljub občasnim zlorabam institut diplomatskih privilegijev in imunitet nepogrešljiv za nemoteno in objektivno delo diplomatov. Menim, da bi s poseganjem vanje hudo prizadeli delovanje diplomacije.

Abstract:The objective of this thesis is to determine the necessity of diplomatic privileges and immunities. In order to do that, I will try to determine whether diplomatic immunity could be limited or even eliminated. In the first part I explain what diplomacy is, its definition and development throughout the history. Diplomatic privileges and immunities have appeared very early on, with the first civilisations, continued to develop until they were finally codified in Vienna convention of diplomatic relations. I present the cases of diplomatic immunities' abuse and the means to prevent the abuse. The conclusion is based on a study of theoretical works and cases where the receiving state didn't respect diplomatic immunity. I believe that despite some occasional cases of abuse, diplomatic privileges and immunities are necessary for diplomats to be able to work without fear of coercion, unjust imprisonment or any other repercussions from the receiving state. If this right was abolished, diplomacy would suffer greatly.
