Title:Vesoljsko pravo varstva okolja : magistrsko delo

Abstract:Magistrsko delo se osredotoča na vprašanje, ali obstoječi pravni sistem za vesoljski sektor v zadostni meri naslavlja mnoštvo okoljskih težav, ki so se pojavile zaradi tehnološkega napredka in širitve vesoljskih akterjev. Degradacija vesoljskega okolja je že tako napredovala, da jo lahko označimo za veliko nevarnost za prihodnje dejavnosti v vesolju. Vesoljski odpadki, ki so z antropocentričnega zornega kota največja grožnja, niso edini okoljski problem v vesolju. Med druge najbolj opazne okoljske probleme povezane z vesoljskimi dejavnostmi prištevamo jedrsko onesnaženje, satelite na sončno energijo, vesoljske postaje s človeško posadko, eksobiološko kontaminacijo, rudarjenje na nebesnih telesih, planetno preoblikovanje, emisije toplogrednih plinov, planetarno obrambo in radiofrekvenčne motnje. Po premišljeni in natančni analizi de lege lata vesoljskega prava s poudarkom na corpus iuris spatialis internacionalis, je ugotovljeno, da obstoječ pravni sistem ne ponuja učinkovitega pravnega varstva pri okoljskih problemih. Vesoljsko pravo je potrebno dopolniti tako, da bo celovito reguliralo okoljevarstveni vidik vesoljskih dejavnosti. Predmet pravnega urejanja bo moral biti utemeljen na poprejšnjem etičnem preudarku in mednarodnemu pravu (varstva okolja).

Abstract:The master thesis focuses on the question whether the existing legal framework for space sector address in a sufficient manner the plethora of new environmental legal issues that arose from technological advancements and the proliferation of space actors. Degradation of the space environment is by now so advanced that it can be characterized as a grave danger to the future space endeavours. Space debris which is from anthropocentric view point the biggest threat is not the only environmental problem in space. Other most noticeable environmental problems related to space activities are nuclear contamination, solar power satellites, manned space stations, exobiological contamination, mining on the celestial bodies, terraforming, greenhouse emissions, planetary protection and radio frequency interference. After fastidious and meticulous analysis of the de lege lata space law with emphasis on the corpus iuris spatialis internacionalis it is concluded that the existing legal framework does not provide effective legal protection regarding environmental problems. Space law must be supplemented in such a way that it will comprehensively regulate the environmental aspect of space activities. The scope of regulation will have to be grounded on preceding ethical deliberation and international (environmental) law.
