Title:Razvoj hrvaškega ustavnega sistema : magistrsko delo

Abstract:Tematika, ki jo obravnavamo v magistrskem delu, je bila pri nas že deležna pozornosti, vendar v manjšem obsegu. Obravnavani dokumenti so izvirali iz različnih jezikov in bili zapisani v različnih pisavah, prevedeni so bili tudi v hrvaški jezik. Kljub temu v posameznih virih naletimo na različne interpretacije in pojmovanja, vendar je v njih ostalo nekaj vrednot, ki zaznamujejo tudi današnjo ustavno ureditev. Magistrsko delo je tako nastalo z veliko željo, da bi kljub jezikovnim in interpretativnim oviram skozi različna zgodovinska opredeljevanja poiskali bistvo predstavljenih pravnih aktov. Po analiziranju prvih zgodovinskih dokumentov in dokumentov skozi različna obdobja do danes smo dokumente medsebojno primerjali ter ugotavljali, kje najdemo njihove korenine tudi v današnji Ustavi Republike Hrvaške. V magistrskem delu smo poleg prvih zgodovinskih zapisov na Hrvaškem predstavili tudi ustavno ureditev Jugoslavije v letih po prvi svetovni vojni in kasneje po drugi svetovni vojni (1946-1990), njene ustave iz let 1946, 1953, 1963 in zadnjo iz leta 1974. V nadaljevanju smo se dotaknili procesa osamosvajanja Hrvaške in sprejetja njene prve ustave 22. decembra 1990. Posebna pozornost je namenjena osnovnim izhodiščem, osnovam, temeljnim določbam, predvsem pa varstvu človekovih pravic in temeljnih svoboščin, državni ureditvi, Ustavnemu sodišču Republike Hrvaške ter vsem ustavnim spremembam po posameznih obdobjih.

Abstract:The topic of this master's thesis has already been discussed among wider public, but not on a large scale. The examined documentation has been written in different languages and scripts, some have even been translated in thed Croatian language. Various interpretations and concepts have been identified in those documents, whereas there remain some values that have marked the present constitutional order. This master's thesis has been written in the great desire of finding the essence of the presented legal acts in spite of linguistic and interpretative obstacles trough different historical definitions. After analyzing the first historical documents and documents through different time periods, their mutual comparison and determination of their roots in the current Constitution of the Republic of Croatia has been made. today. The master's thesis also presents the constitutional arrangements of Yugoslavia in the years after the First World War, and later after the Second World War (1946-1990), its Constitution from 1946, 1953, 1963, and the last one of 1974. In the following, the process of Croatia's independence and the adoption of its first constitution on December 22, 1990, is discussed. Special attention has been given to the basic starting points, basics, basic provisions, in particular the protection of human rights and fundamental freedoms, the state regulation, the Constitutional Court of the Republic of Croatia and all constitutional changes by individual periods.
