Title:Solidarnost držav članic med emigrantskim pravom in načelom nevračanja : diplomsko delo

Abstract:Diplomsko delo pod naslovom Solidarnost držav članic med migrantskim pravom in načelom nevračanja je raziskovalno delo, ki predstavlja začetek težnje po stalni ureditvi migracijskega prava in prvih korakih, ki so pokazali, da je potreben celostni pristop. Pot oblikovanja zakonodaje se do danes ni končala in je v delu predstavljena iz nacionalnega vidika in skupnega evropskega prostora. Kot so nakazale že številne raziskave,je najboljša pot zavrnjenih prosilcev za azil pritožba na Evropsko sodišče za človekove pravice. Ker pa poudarjamo načelo nevračanja,je prikazan kronološki vrstni red sodb, ki jih je sodišče obravnavalo do konca leta 2016. Odločitve sodišča so živ organizem, ki se je oblikoval skladno z vsemi aktualnimi spremembami, tako z uvedbo pilotnih sodb, kot sta Ališić in drugi proti Sloveniji ter Kurić proti Sloveniji, kot s strogim neodobravanjem kolektivnih izgonov, saj naj bi bila vsakomur zagotovljena individualna obravnava. Dodano vrednost predstavljajo dosedanje ocene in raziskovanje, ki omogočajo statistični vpogled in kljub vse podrobnejši ureditvi še vedno nakazujejo na pravne vrzeli, predvsem v obliki prenosa ali izogibanja odgovornosti. Opredelitev do raziskovalnega dela je zaokrožena z mislimi, ki so sledile prebiranju in pisanju.

Abstract:This thesis, entitled Solidarity of Member States between migration law and the principle of non-refoulement, is a research that constitutes the first step towards permanent regulation of migration law, which requires an integrated approach. The process of drawing up legislation is far from over, which is why this thesis provides an overview from the national as well as the common European perspective. According to several pieces of research, the best option that rejected asylum seekers have is to appeal to the European Court of Human Rights. But because the principle of non-refoulement is the most important, this thesis provides a chronological list of judgements that the Court processed by the end of 2016. Court decisions are live organisms formed in line with current changes, including pilot judgements. The most important judgements involving our territory are Ališič and others vs. Slovenia and Kurić vs. Slovenia, and strict disapproval of collective expulsions because each indidivual is entitled to individual processing. Added value is recognised in assessments and research performed thus far asthey provide a statistical insight into the field and point to regulatory gaps, such as transferring or avoiding responsibility. The stance towards research is supported by our thoughts that occurred while reading and writing.
