Title:Sklenitev zakonske zveze v luči suma zlorabe : magistrsko delo

Abstract:Magistrsko delo govori o zakonski zvezi nekoč, o njenem mednarodnem in domačem pravnem vidiku in zlorabi tega instituta danes s strani tujcev, ki s slovensko državljanko sklenejo zakonsko zvezo zgolj zaradi ugodnosti, ki jih imajo po veljavni zakonodaji Republike Slovenije in Evropske unije. Število imigracij državljanov Bosne in Hercegovine, Srbije, Črne gore, Republike Severne Makedonije in Kosova v Evropsko unijo se je v letih 2011-2016 zvišalo za 2,3 %, v Republiko Slovenijo pa za 27 %, glede na skupno število prijavljenih oseb v Evropski uniji in v Republiki Sloveniji. Gre za migracije, ki so ekonomsko pogojene, tudi spodbujane s strani države. Zloraba instituta sklenitve zakonske zveze se izvajaja na način, da se tujec poroči s slovensko državljanko, saj mu sklenjena zakonska zveza omogoči takojšen vstop v Republiko Slovenijo, prost dostop na slovenski trg dela ter ugodnejše pogoje pridobitve dovoljenja za stalno prebivanje in slovenskega državljanstva. Indic zlorabe sklenitve zakonske zveze lahko zazna že matičar, ki navidezno oz. fiktivno zakonsko zvezo sklepa, nezakonito dejanje pa lahko prepreči uradnik, ki na upravni enoti odloča v postopku pridobitve dovoljenja za prebivanje tujca, z izdajo negativne odločbe. Da do zlorab instituta sklenitve zakonske zveze dejansko prihaja, potrjujejo podatki Policije in Vrhovnega državnega tožilstva Republike Slovenije, saj je odstotek obtožnih aktov z označbo navidezna poroka v zadnjih treh letih narastel iz 10 % na 20 %. Kazenski zakonik zlorabe instituta sklenitve zakonske zveze ne vsebuje. Morda je tudi to razlog, da noben obtožni predlog navidezne poroke ni dobil kaznovalnega sodnega epiloga.

Abstract:The master's thesis discusses marriage in the past, its international and domestic legal aspect and the abuse of this institute today by foreigners who enter a marriage with a Slovenian citizen only because of the benefits that they are entitled to under the current legislation of the Republic of Slovenia and the European Union. The number of immigrations of citizens of Bosnia and Hercegovina, Serbia Montenegro, North Macedonia and Kosovo into European Union increased by 2.3 % from 2011 to 2016, and into Republic of Slovenia by 27 %, according to the total number of registered persons in the EU and the Republic of Slovenia. These are economically conditional migrations, which are also encouraged by the state. Institute of marriage are carried out in a way that foreigner % men marry a Slovenian citizen, since the marriage allows for immediate free admission to the Republic of Slovenia, immediate access to the Slovenian labor market and more favorable conditions for obtaining a permit for permanent residence and Slovenian citizenship. Indication of an abuse of marriage can already be detected by a registrar who is conducting an apparent or a fictitious marriage. Irregular migration can be prevented by an official who, in the process of obtaining a residence permit for a foreigner, issues a negative decision. The fact that the institute of marriage is actually being abused is confirmed by the data of the Police and the Supreme State Prosecutor's Office of the Republic of Slovenia, since the percentage of offenses with the designation apparent marriage has increased from 10 to 20 % in the last three years. The Penal Code does not contain an abuse of the institute of marriage. Perhaps this is also the reason why no chargeable claim - an apparent or fictive marriage - has not received a punitive judicial epilogue.
