Title:Uspešno vodenje gradbenih projektov s pravnega vidika : magistrsko delo

Abstract:Operativno vodenje del od izvajalca zahteva ne le tehnološko znanje, temveč tudi poznavanje množice predpisov tako iz javnega kot zasebnega prava. Namen magistrskega dela je proučiti področno zakonodajo, katera veže gradbene izvajalce in njihove operativne vodje del ter jo strniti v delo, ki bo pripomoglo k učinkovitejšem delu gradbeno operativne stroke. S pomočjo induktivne metode je na podlagi konkretnih gradbenih pogodb izluščena bistvena regulativa, katera veže izvajalce pri izvedbi gradbenih projektov, oddanih na podlagi javnih naročil. Podatki, pridobljeni iz študije primerov, so združeni s sintetično metodo in nato s pomočjo komparativne metode konkretizirani na aktualni gradbeni pogodbi. Raziskava je pokazala, da Zakon o javnih naročilih bistveno vpliva na operativno vodenje gradbenih projektov. Določila Zakona o javnih naročilih je potrebno upoštevati neglede na to ali je gradbena pogodba sklenjena z uporabo Posebnih gradbenih uzanc ali z uporabo mednarodnimi določili FIDIC. Neglede na tip gradbene pogodbe slednja ne sme kršiti kogentnih določil slovenskega prava. Študija primerov je dokazala, da je prav poznavanje kogentnih določil za izvajalce izrednega pomena, saj so gradbene pogodbe nemalokrat pisane v neskladju z načeli področnih zakonov in dobrimi poslovnimi praksami. Magistrsko delo po svoji vsebini lahko služi kot pravni priročnik za operativne vodje del in tako do naslednje večje zakonodajne spremembe pripomore k uspešnejšemu vodenju del.

Abstract:To manage operational works the contractor requires not only technological knowledge, but also knowledge of regulations from both public and private law. The purpose of the master's thesis is to study the sectoral legislation, which binds the construction contractors and their operational managers and then consolidates it into a work, which will contribute to a more efficient work of the construction operative profession. By means of an inductive method the essential regulations are drawn up in concrete construction contracts, which were awarded on the basis of public procurement. The data obtained from the case study is combined with the synthetic method and then concretized in a valid construction contract by using a comparative method. The research showed that the Public Procurement Act significantly affects the operational management of construction projects. The provisions of the Public Procurement Act should be taken into consideration, regardless of whether the construction contract is concluded using the Special construction shackles or using the international FIDIC provisions. Irrespective of the type of construction contract, the latter should not violate the cogent provisions of Slovenian law. The case study has proven that the understanding of cogent provisions for contractors is of utmost importance since construction contracts are often written in non-compliance with the principles of sectoral laws and good business practices. In its content, the master's thesis can serve as a legal manual for operational works, and contribute to a more successful management of the work until the next major legislative changes.
