Title:Problematika prenosa kmetije na mladega prevzemnika : magistrsko delo

Abstract:Potreba po proizvodnji hrane v svetu se dandanes skupaj z rastjo prebivalstva ves čas povečuje, zato je kmetijstvo ena temeljnih dejavnosti za obstoj prebivalstva. Kmetije se najpogosteje prenašajo znotraj družin (t. i. družinske kmetije), a tudi v Sloveniji se - podobno kot v drugih razvitih državah - prevzemi kmetij zmanjšujejo. Zaradi tega je izredno pomembno, da kmetijstvu namenimo posebno varstvo in skrb. Kmetijstvo namreč spada med tista področja delovanja države, ki je odločanje in sprejemanje pravnega reda v največji meri prepustilo skupnim ustanovam in organom Evropske unije. Večina zakonodaje tako nastaja v Svetu in Evropskem parlamentu na predlog Evropske komisije, z njo pa se dnevno srečujejo državni uradniki, politiki ter kmetje in njihovi predstavniki. Povezovanje z EU in ostalimi državami članicami je tako ključnega pomena za zagotovitev zadostne in kakovostne hrane. Mladi prevzemniki kmetij največkrat prevzamejo kmetijo prednika z dedovanjem. Dedovanje kmetijskih gospodarstev pa pri nas ureja poseben zakon, s katerim skuša država preprečiti drobitev zaščitenih kmetij, omogoča njihov prevzem pod pogoji, ki dediča ne obremenjujejo preveč, ter ustvarja možnosti za ohranitev in krepitev gospodarske, socialne in ekološke funkcije zaščitenih kmetij. Za zagon kmetijske dejavnosti pa so mladim prevzemnikom kmetij v zelo veliko pomoč tudi subvencije EU. Pri vsem tem pa se nam poraja tudi vprašanje, ali so javnopravne omejitve prenosa kmetijskih zemljišč morda vseeno prestroge ter preveč posegajo v ustavnopravne pravice: v temeljno človekovo pravico - lastninsko pravico, zapustnikovo svobodno voljo razpolaganja s premoženjem ter prost pretok kapitala.

Abstract:The World's need to produce more food, together with the growth of population, keeps growing to this day, therefore agriculture is one of the key industries fort he survival of World's population. The farms are most often passed on within the family (family farms), but same as in the rest of the developed world in Slovenia too farms are passed on less and less. Because of this, it is extremely important we pay special care to agriculture. Agriculture is one of the fields, which's regulation has been mosty transferred from Member States domain to institutions and authorities within European Union. Most of the legislation regulating the agricultural policies is made by European Council and European Parliament, with European Commission being the one which propses the solutions. Integration with EU and other Member States is the key to quality food. The young heirs to farms usually inherit a farm from their ancestor. The inheritance of agricultural economies in Slovenia is regulated by a special law. It's aim is to prevent futher fragmentation of protected farms, to protect the heir to the from being overburdened and to save and empower the economic, social and ecological function of protected farms. To help to startup the agricultural industries, EU subsidizes the young heirs to farms. But the question is, are these limitations to inherit or pass on the farm by other means too strict and are in conflict with the fundamental constitutional right, the right to property, testator's free will and free movement of capital.
