Title:Mediacija in Družinski zakonik : diplomsko delo

Abstract:V zadnjih letih je mediacija v Sloveniji pridobila pomembno veljavo. Slovenska sodišča so mediacijo v družinskih sporih začela poskusno izvajati že leta 2002, in sicer po zgledu Danske, ki je kot prva začela izvajati pilotski projekt sodišču pridružene mediacije v civilnih zadevah, ki je bil uspešen in mu je zato sledila tudi Slovenija. V pilotski projekt družinske mediacije na Okrožnem sodišču v Ljubljani so vključeni družinskopravni spori in spori iz premoženjskih razmerij med zakoncema in zunajzakonskima partnerjema, in sicer spori o vzgoji, varstvu in preživljanju otrok, spori glede izvrševanja pravice do osebnih stikov ter spori glede obsega delitve skupnega premoženja zakoncev. To področje sta do Družinskega zakonika urejala predvsem dva zakona, in sicer Zakon o mediaciji v civilnih in gospodarskih zadevah ter prej omenjeni Zakon o alternativnem reševanju sodnih sporov. Družinski zakonik je dolgo pričakovan zakon. Cilj družinske mediacije je, da se s pomočjo ene ali več nevtralnih tretjih oseb skuša doseči mirno rešitev spora, ki izhaja iz medsebojnih družinskih razmerij. Zelo pomembno vlogo v postopku mediacije imajo tudi otroci in mladostniki, saj družinska mediacija ustvari okolje, kjer se starši konstruktivno pogovarjajo o čustvih in potrebah otrok ter sprejemajo odločitve glede vzgoje in varstva. Diplomsko delo predstavi mediacijo po Družinskem zakoniku kot eno izmed zahtevnejših, kjer se običajno partnerja srečujeta z mnogimi dilemami in izzivi. Skozi celotni postopek mediacije, ki ustvarja tudi vizijo boljše prihodnosti, si je potrebno prizadevati za oblikovanje novih pogledov in iskanje novih začetkov, saj prav večini ljudi največ pomeni beseda družina.

Abstract:In recent years, mediation has achieved an important value in Slovenia. Slovenian courts started to perform mediation experimentally already in 2002, according to the example of Denmark which was the first to start to perform a pilot project of mediation joined to the court in civil matters. The project was successful and Slovenia followed the Danish example. Family-law disputes and rights-in-property disputes arising out of matrimonial and common-law partner relationships were included in the pilot project of family mediation at the Ljubljana District Court, i.e. disputes on upbringing, care, and supporting the children, disputes regarding exercising the right to personal contacts, and disputes regarding the scope of liquidation of the matrimonial property. Until the Family Code, two laws settled the field mostly, i.e. the Mediation in Civil and Commercial Matters Act and previously mentioned the Act on Alternative Dispute Resolution in Judicial Matters. The Family Code is a long-awaited law. The goal of family mediation is to try to reach a peaceful solution of a dispute deriving from mutual family relationships by means of one or several neutral third persons. Children and juveniles have a very important role in the procedure of mediation because family mediation creates an environment where parents talk constructively about children%s emotions and needs and reach the decisions regarding the upbringing and care. The bachelor%s thesis presents mediation according to the Family Code as one of the more demanding where the partners usually face many dilemmas and challenges. Through the entire procedure of the mediation which also creates a vision of better future, it is necessary to strive for forming new perspectives and searching for new beginnings, as the word family means most to the most of people.
