Abstract:Mediacija se v primerjavi s sodnim postopkom v večini primerov kaže kot bolj učinkovit proces pri razreševanju družinskih sporov. Stranke v sporu, ki se odločijo za postopek družinske mediacije, vidijo v njem prednost pred postopkom na sodišču zaradi samega postopka prilagodljivosti, pa tudi zaradi načina izvajanja, ki je človeku blizu ter mu daje možnost aktivno sodelovati pri sporu. Na ta način imajo stranke v sporu več kontrole nad tem, kako postopek teče, se nadaljuje in zaključi. Tako je mediacija primerna predvsem, ko želijo stranke še naprej ohraniti dober odnos in kadar je zaželena kreativna rešitev spora. Družina ostaja še naprej povezana skozi skrb za otroke, saj naj bi pri sprejemanju odločitev v prvi vrsti upoštevali koristi otrok. Po zaključeni mediaciji namesto ene ali celo dveh nezadovoljnih strank, kot se to pogosto zgodi po sojenju, dobimo dve zadovoljni. Diplomska naloga na kratko predstavi družinsko mediacijo kot metodo za reševanje družinskopravnih sporov ter opredeli njeno primernost in potrebnost. Izpostavljeni so dejavniki, ki vplivajo na stranke v sporu, da se le-te odločijo spor urediti z udeležbo v postopku mediacije.

Abstract:In most cases, mediation seems to be a more efficient process in resolving family disputes than court proceedings. The parties to the dispute who decide for family mediation see it as an advantage compared to court proceedings due to its flexibility and also the manner of implementation, which is focused on the party and enables it to actively participate in the dispute. Thus, the parties have more control over the procedure, its progress, continuation and conclusion. Mediation is thus particularly suitable when parties wish to maintain a good relationship and when a creative solution of the dispute is desired. What is the most important is for the parents to be aware that even though they are separating, the connection to their children remains forever and that when adopting decisions, they give priority to the child's benefits. After the completion of mediation we have two satisfied parties instead of one or even two dissatisfied parties, which is often the case in court proceedings. The thesis briefly presents family mediation and its suitability and necessity as a method for resolving family legal disputes. Factors that affect the parties to the dispute in deciding to try and resolve the dispute through a mediation procedure are also pointed out.
