Title:Kazenskopravni in preiskovalni vidik zlorab virtualnih valut : magistrsko delo

Abstract:Stalni razvoj virtualnih valut, njihova nezadostna pravna regulacija in ostale njihove značilnosti, kot so decentraliziranost, anonimnost, globalnost ter kompleksnost tehnologij, iz katerih izhajajo, predstavljajo za varnostne organe nove izzive pri preiskovanju kaznivih dejanj v povezavi z zlorabami virtualnih valut. Namen magistrskega dela je preveriti, kako lahko različne pravne in tehnične omejitve vplivajo na uspešnost preiskav tovrstnih kaznivih dejanj. Obravnavano področje magistrskega dela so psevdonimne, decentralizirane, zamenljive virtualne valute, s poudarkom na trenutno najbolj priljubljeni virtualni valuti bitcoin. V delu je s pravnega vidika opredeljen pojem virtualna valuta, opisane so značilnosti virtualnih valut in predstavljeni različni tipi bitcoin denarnic. Opisano je razmerje med zasebnim ključem, javnim ključem in bitcoin naslovom ter predstavljeno delovanje omrežja Bitcoin. Delo v nadaljevanju z vidika kazenskega prava obravnava materialno pravni in procesno pravni ter preiskovalni vidik zlorab virtualnih valut. Predstavi pa tudi nekaj pogostejših anonimizacijskih ukrepov, ki jih storilci kaznivih dejanj uporabljajo, da bi otežili sledenje toku transakcij virtualnih valut in posledično onemogočili preiskovanje tovrstnih kaznivih dejanj. V zaključku magistrskega dela so predstavljena relevantna spoznanja, stališča in ugotovljena dejstva, ki bodo lahko v pomoč pri nadaljnjem razvoju kazenskega prava na področju preiskovanja kibernetske kriminalitete oziroma preiskovanja zlorab virtualnih valut.

Abstract:The constant development of virtual currencies, their inadequate legal regulation and other characteristics, such as decentralization, anonymity, globality and complexity of technologies from which they derive, present security authorities investigating criminal acts in connection to the abuse of virtual currencies with new challenges. The purpose of this master's thesis is to examine how various legal and technical limitations can influence the success of investigating such criminal acts. The discussed areas of the master's thesis are pseudonymous, decentralized, convertible virtual currencies, with the emphasis on the currently most popular virtual currency bitcoin. The thesis defines the concept of virtual currency from the legal aspect; it also describes the characteristics of virtual currencies and presents various types of bitcoin wallets. The relation between the private key, the public key and bitcoin address is described, as well as the functioning of bitcoin network. From the aspect of criminal law, the thesis discusses the aspects of substantive law and procedural law, as well as the investigative aspect of the abuse of virtual currencies. It also presents some of the most frequent measures of anonymity used by perpetrators of criminal acts to intensify the following of the stream of transactions of virtual currencies and consequently prevent the investigation of such criminal acts. The relevant findings and points of view presented in the conclusion of the thesis could help advance the development of criminal law, as well as the field of cybercrime investigation and help fight the abuse of virtual currencies.
