Title:Iracionalnost prava - vpliv vrednot in čustev na objektivnost : magistrsko delo

Abstract:Pravo se veže na filozofsko misel, da smo ljudje racionalna bitja. Zanemarja pa vpliv podzavesti in s tem povezano (i)racionalnost. V luči ločevanja iracionalnega in racionalnega pogostokrat ne uvidimo lastne zmote - ponavljamo iste vzorce (napake). Pravo pri tem ni izjema. Magistrsko delo odkriva, kako in v kolikšni meri so argumenti in pravna pravila vezani na čustva ter vrednote. Delo preučuje vpliv moralnih temeljev (temeljev morale) na percepcijo dejanskega stanja in ustvarjanje prava. Skozi analizo in primerjavo nacionalne prakse Ustavnega sodišča Republike Slovenije (US RS) postavlja pod vprašaj racionalnost pravnih rešitev, bodisi v odločbah US RS, bodisi v področni zakonodaji. Naloga ugotavlja odstopanja od prakse in izpostavlja morebitne razloge za odstop. V povezavi s premišljenostjo (i/racionalnostjo) posamezne rešitve izpostavlja, kako državni instituciji - US RS in Državni zbor - s svojimi odločitvami, javno agitacijo, z uporabo čustev ali z zlorabo čustev drugih, vplivajo na razvoj prava ter njegovo učinkovitost. Delo gradi na tezi, da vrednote in čustva igrajo pomembno vlogo v sodobnem pravu, pri tem pa izhaja iz teorije moralnih temeljev (temeljev morale), kot jo je razvil Jonathan Haidt s sodelavci. Teorija predpostavlja šest univerzalnih vrednostnih (moralnih) temeljev, ki vplivajo na to, kako vidimo in obravnavamo svet okoli nas. Na tej podlagi je izvedena tudi primerjava in analiza argumentov treh odločb US RS: U-II-3/11, U-I-111/04 in U-I-140/14. Iz citiranih odločb so izluščena čustva in moralni temelji, ki so bili ključni za odločanje. V zaključku dela je izpostavljeno, katere vrednote vplivajo na slovenski pravni sistem in na kakšen način se ta vpliv kaže.

Abstract:Law is ruled by the philosophical mindset that people are rational beings but it disregards the influence of sub-consciousness and therefore (ir)rationality. The thesis discovers how and to what extent the arguments and the rules of law are connected to values and emotions. I study the influence of moral foundations (the foundations of morality) and emotions to perception of law and creating law. In the light of distinguishing irrational and rational we do not see our own error because of which we repeat the same patterns (errors). In law it is the same as in other segments of life. Through the analysis and comparison of national practice of Constitutional Court of Republic Slovenia the thesis questions the rationality of legal decisions either in the orders of Constitutional Court of Republic Slovenia or departmental legislation. The thesis finds out the deviations from practice and points out the possible reasons for deviating. In connection with prudence (irrationality or rationality) of a certain decision it points out how actual national institutions (the Constitutional Court of RS and National Assembly) by their decisions, public agitation, using emotions or the misuse of others' emotions, influence the development of law in its efficiency. The thesis is built on the hypothesis that values and feelings play an important role in modern law; it originates in the theory of moral foundations (or the theory of foundations of morality) that was developed by Jonathan Haidt with co-workers. The theory presumes six universal value (moral) foundations that influence how do we see and deal with the world inside and around us. On this basis a comparison and analysis of arguments of three orders of Constitutional Court of the Republic Slovenia have been made, namely: U-II-3/11, U-I-111/04 and U-I-140/14. From the quoted orders emotions and moral foundations that were crucial in decision making are extracted. In the closure it is pointed out what values affect Slovenian system of law and how it this effect seen.
