Title:Izzivi pravne države na področju ureditve varstva okolja pred onesnaževanjem s hrupom : magistrsko delo

Abstract:Hrup je nezaželen zvok človeške dejavnosti, ki vpliva na kakovost življenjskega okolja in zdravje ljudi. Varstvo pred prekomernimi emisijami hrupa določa 72. člen Ustave Republike Slovenije v sklopu pravice do zdravega življenjskega okolja. Raziskava se osredotoča na učinkovito delovanje države za varstvo ljudi pred hrupom prek pravnih predpisov in njihove implementacije. V magistrskem delu so v prvem delu predstavljeni okoljski hrup, njegove pojavne oblike, fizikalne osnove, oblike varstva in vplivi na zdravje ljudi. Podrobno je proučena pravna ureditev na nacionalni ravni s poudarkom na podzakonskih predpisih, pri čemer nismo pozabili na vpliv mednarodnega in regionalnega prava. V drugem delu je predstavljen konkretni dejanski primer vira hrupa gostinskega obrata, ki obratuje z živo in mehansko glasbo na zunanji površini. Proučen je potek postopkov inšpekcijskega nadzora, obratovalnega monitoringa, postopka izdaje soglasja za obratovanje v rednem in podaljšanem obratovalnem času ter postopka policijskih nalog. Celota proučevanega je pripomogla k oblikovanju dvajset izzivov, ki predstavljajo anomalije v pravnem sistemu, k temu pa smo dodali rešitve, oblikovane v okviru pravnega sistema, z željo po višanju standardov varstva pred hrupom v sorazmerju z zavarovanimi ustavnimi pravicami. V zadnjem delu raziskave so proučeni neintegriteta in netransparentnost na področju postopka sprejemanja podzakonskih aktov ter koruptivna tveganja v postopkih izdaje posamičnih pravnih aktov na področju okoljskega hrupa. Iz analize izhaja ugotovitev o sistemski nevarnosti nastanka korupcijskih tveganj na področju okoljskega hrupa. Ugotovitve o neučinkovitem pravnem varstvu in korupcijskih tveganjih opozarjajo na nujnost sprememb pravne ureditve in spodbujajo k večji ozaveščenosti o negativnih vplivih hrupa na življenjsko okolje.

Abstract:Noise is an unwanted sound of human activity affecting the quality of the living environment and human health. The protection against excessive noise emissions is laid down in the Constitution of the Republic of Slovenia within the framework of the right to a healthy living environment in Article 72. The research focuses on the effective functioning of the state for the protection of people against noise through legal regulations and their implementation. The thesis in the first part presents the environmental noise, its manifestations, the physical basics, the forms of protection and the effects on human health. The examination continues with the presentation of legal system at national level with an emphasis on secondary legislation, while not forgetting the impact of international and regional law. In the second part of the paper, we present a concrete actual case of a restaurant as a noise source, which operates with live and mechanical music on the outdoor area. It examines the course of inspection procedures, operational monitoring, the procedure for issuing consent for the operation in regular and extended working hours and the procedures of police tasks. The whole of the study has contributed to the creation of twenty challenges that represent anomalies in the legal system, adding to this the solutions created within the legal system with the desire to raise the standards of protection against noise in proportion to the protected Constitutional rights. The last part of the research examines non-integrity and non-transparency in the procedure of adopting and implementing regulations and corruptive risks in the procedures of individual legal acts in the field of environmental noise. The analysis shows the systemic risk of corruption in the field of environmental noise. Findings about ineffective legal protection and corruption risks point to the need to change the regulation and encourage awareness about the negative effects of noise on the living environment.
