Title:Kazenski postopek zoper mladoletnike - statistika slovenskega in italijanskega sistema : diplomsko delo

Abstract:Posledica posebnega obravnavanja mladoletnikov v materialnem kazenskem pravu je, da sodobna narava kazenskih sankcij za mladoletnike zahteva, da se v tem postopku globlje razišče njihova osebnost in uporabi kar najbolj primerna kazenska sankcija z izključno prevzgojnim namenom. Poleg tega je treba ugotoviti tudi njegovo starost, okoliščine, ki vplivajo na presojo duševne razvitosti mladoletnika, proučiti razmere oziroma okolico, v kateri mladoletnik živi, in druge okoliščine glede njegove osebnosti. Mladoletniški postopek se pri nas uporablja zoper osebe, ki so kaznivo dejanje storile kot mladoletniki, pa ob sojenju oziroma ob uvedbi postopka še niso stare enaindvajset let. Mladoletnik je tisti, ki je ob izvršitvi kaznivega dejanja (ne pripravljanja) dopolnil 14 let, pa še ni star 18 let. Mladoletnik, ki v času storjenega dejanja, ki je kaznivo, še ni star 14 let, ni kazensko odgovoren. Nekatere določbe iz mladoletniškega postopka pa se uporablja tudi v postopku zoper mlajšega polnoletnika, ki je storil kaznivo dejanje kot mlajši polnoletnik (18-21 let). Naš procesni zakon ima postopek zoper mladoletnike urejen v posebnem poglavju (členi od 451 do 490). Vendar zakon dopušča možnost, da se tudi v postopku zoper mladoletnike uporabljajo določbe rednega postopka, če le-te ne nasprotujejo posebnim določbam mladoletniškega postopka. Glede na statistiko je v Sloveniji od leta 2009 do leta 2017 kriminaliteta mladih upadla, posledično je bilo tudi manj izrečenih vzgojnih ukrepov.

Abstract:When treating juveniles in modern material criminal law we must thoroughly research their personality and use the most appropriate criminal-law sanctions with exclusively re-educational purposes. Next to the facts relating to the criminal offence and the perpetrator, we must foremost find out the juvenile's age and circumstances, which is necessary for the evaluation of the juvenile's mental development; we must also research the juvenile's environment and living conditions as well as other circumstances regarding his/her personality. In Slovenia the juvenile procedure is used against persons who have committed a criminal offence as juveniles and are less than 21 years of age at the time of trial. A juvenile is someone who at the time of execution of the criminal offence (not the preparation) was 14 years old and not yet 18. A juvenile under the age of 14 is not criminally responsible. Some provisions from the juvenile procedure are also used against a younger juvenile who has committed a criminal offence as a younger adult (18-21 years). Slovenian procedural law manages the procedure against juveniles in a special chapter (articles 451-490), but it permits the possibility that even in the procedure against juveniles, provisions of regular procedures can be used, if they are not in contradiction with special provisions of the juveniles procedure. According to the statistics from 2009 to 2017 juvenile criminality is in decline; as a consequence there are fewer educational measures are pronounced.
