Title:Pridobivanje telekomunikacijskih podatkov v Republiki Sloveniji in znotraj Evropske Unije : diplomsko delo

Abstract:Diplomsko delo se osredotoča na pridobivanje telekomunikacijskih podatkov od organov pregona in pravosodnih organov v Republiki Sloveniji in Evropski uniji v kazenskih zadevah. Z razvojem tehnologije, elektronske komunikacije in spleta so se odprle številne možnosti za sodelovanje med milijoni ljudi po vsem svetu in poleg številnih pozitivnih dejavnikov prinesle tudi številne možnosti za kriminalna dejanja. Zaradi lažje dostopnosti do osebnih podatkov posameznikov je ogrožena zasebnost ljudi, zato je zelo pomembno, da se dostop do osebnih podatkov pravno uredi tako, da zasebnost ne bo ogrožena in da bo pravosodnim organom hkrati omogočeno, da bodo v primerih določenih kaznivih dejanj imeli možnost pridobitve določenih podatkov o posameznikih oziroma telekomunikacijskih podatkov, ne da bi pri tem kršili človekove pravice in prekomerno (nesorazmerno) posegali v zasebnost posameznikov. Gre za nevarnost nastanka "preventivne" države in vprašanje, v kolikšni meri pravila iz realnega sveta (npr. potreba po sodni avtorizaciji) veljajo tudi v digitalnem okolju. Namen diplomskega dela je analizirati trenutno ureditev pridobivanja telekomunikacijskih podatkov v Republiki Sloveniji in v okviru Evropske unije. Namen je prav tako kritično proučiti prihodnjo ureditev, predvsem predlog Uredbe Evropskega parlamenta in Sveta o evropskem nalogu za predložitev in evropskem nalogu za zavarovanje elektronskih dokazov ter predlog stališča Republike Slovenije do tega predloga Uredbe.

Abstract:The diploma paper focuses on the gathering by law enforcement of telecommunications data in the Republic of Slovenia and the European Union in criminal matters. With the development of technology, electronic communications and the Internet, many opportunities for cooperation between millions of people around the world have opened up. In addition to many positive factors there are also many opportunities for criminal offences. In order to facilitate access to personal data of individuals, the privacy of people is jeopardized and, therefore, it is very important that access to personal data is regulated in a way that does not compromise privacy and that, at the same time, judicial authorities will be able to, in cases of certain criminal offenses, to obtain certain data on individuals or telecommunications data, without violating human rights and excessively encroaching on the privacy of individuals. The purpose of the diploma thesis is to analyze the current regulation of the acquisition of telecommunications data in the Republic of Slovenia and within the European Union and to examine the future legal framework, in particular the proposal for a Regulation of the European Parliament and of the Council on the European Order for submission and the European Order for the Protection of Electronic Evidence and the proposal of the Republic of Slovenia's position on this proposal Of the Regulation.
