Title:Prepoved delegacije pristojnosti v Evropski uniji in učinki Meroni doktrine : diplomsko delo

Abstract:Jedro razumevanja delovanja agencij in problematike povezane z njimi predstavlja Meroni doktrina, ki jo je razvilo Sodišče Evropske unije. Slednja je uredila in zamejila ustanavljanje in delovanje agencij ter oblikovala pogoje, načela in standarde, ki predstavljajo integralni del decentralizacije upravno-izvršilne oblasti. Agencije delujejo na širokem geografskem območju in upravljajo, izvršujejo ali nadzirajo izvajanje področnih politik Evropske unije. Da bi agencije lahko učinkovito izvrševale svoje naloge, je pomembno, da je podlaga za prenos pristojnosti in dano pooblastilo skladno tako s sekundarnim kot s primarnim pravom Evropske unije. Na podlagi ustreznega pooblastila in delegiranih pristojnosti agencije izdajajo akte z učinkom tudi za tretje osebe, ki so podvrženi sodnemu nadzoru. V diplomskem delu je bil z uporabo analitične, deskriptivne, normativne in zgodovinske metode raziskan razvoj agencij, njihova organizacija ter področja delovanja. Delo bo v jedru obravnavalo relevantno sodno prakso, ki je uvedla, uredila in dopolnila doktrino ter predpise, ki urejajo agencije. Po opravljeni analizi bodo raziskani in predstavljeni pravni učinki izdanih sodb in njihov pomen. Z namenom predstavitve podlage ustanavljanja in delovanja agencij ter uporabe Meroni doktrine, je cilj naloge, bolje razumeti izvor in naravo pravne podlage nastanka agencij ter omejevanja delegacije pristojnosti. Delo združuje znanstvene prispevke, sodno prakso in relevantna pravna pravila, ki oblikujejo ne le del področja evropskega upravnega prava, temveč tudi širši pravni prostor Evropske unije. Z delom bo v slovenskem jeziku predstavljena širša problematika načina decentralizacije oblasti, podlaga za tovrstne ukrepe, narava delegacije pristojnosti in njen obseg.

Abstract:At the heart of understanding the work of agencies and the issues surrounding them is the Meroni doctrine developed by the Court of Justice of the European Union. The latter has regulated and delimited the establishment, operation of agencies and formulated the conditions, principles and standards that represent an integral part of administrative and executive decentralization. Agencies operate in a wide geographical area and manage, enforce or control the implementation of European Union sectoral policies. In order for the agencies to carry out their tasks effectively, it is important that the basis for the delegation of powers and the powers conferred, are consistent with both secondary and primary law of the European Union. Pursuant to the appropriate authority and delegated powers, agencies issue acts which can also effect third parties and as a result they are subject to judicial review. The diploma thesis will explore and elaborate the development of agencies, their organization and fields of activity using analytical, descriptive, normative and historical methods. The core part of the diploma will include an analysis of crucial case law that has introduced, edited and supplemented the Doctrine and regulations governing agencies. Following the case law presentation, the legal effects of the judgments delivered and their meaning will be presented. In order to present the basis for the establishment and operation of agencies and the application of the Meroni Doctrine, the aim of the diploma is to better understand the origin and nature of the legal basis for the creation of agencies and limitation of delegating powers. The diploma combines academic and scientific contributions, case law and relevant legal rules that shape not only part of European administrative law, but also the wider legal area of the European Union. For the first time in the Slovenian language the manner of decentralization of power, the basis for such measures, the nature of the delegation of powers and its scope, will be presented through the diploma thesis.
