Title:Varstvo človekovih pravic v postsovjetskih družbah : magistrsko delo

Abstract:Človekove pravice in temeljne svoboščine skladno s sodobnim razumevanjem demokratične in pravne države ležijo v osrčju vsake družbe, katere temeljni cilj je zagotavljanje blaginje in svobode slehernemu posamezniku. V magistrskem delu je na kratko opisana zgodovina ZSSR, v okviru katere so kronološko predstavljeni ključni dogodki, ki so omogočili vzpon in povzročili padec enega najbolj krutih totalitarnih režimov v novejši zgodovini. Kot kontrast teptanju dostojanstva in svobode posameznikov v ZSSR so v nadaljevanju predstavljeni mehanizmi varstva človekovih pravic, tisti vzpostavljeni na mednarodni ravni ter tisti na ustavni ravni obravnavanih držav. Osrednji del magistrskega dela je primerjava med enaindvajsetimi državami, katerih predhodnice so bile republike ZSSR in satelitske države pod političnim, ekonomskim in ideološkim vplivom le-te. Obravnavane države so na različnih točkah tranzicije, kar se odraža tudi v stopnji varstva človekovih pravic. Za namene tega magistrskega dela je poglavitni razlikovalni element med obravnavanimi državami članstvo v Svetu Evrope. Zaradi dostopnosti statističnih podatkov o številu kršitev Evropske konvencije o varstvu človekovih pravic in temeljnih svoboščin je bilo možno med državami članicami SE opraviti kvantitativno primerjavo, medtem ko je bilo med državami članicami SE in tistimi, ki niso članice, primerjavo možno opraviti le na podlagi njihovih veljavnih ustavnih ureditev ter med mehanizmi varstva, ki jih le-te vzpostavljajo. Čeprav imajo vse obravnavane države v ustavna besedila vključene obsežne kataloge človekovih pravic in temeljnih svoboščin, se uresničevanje le-teh v praksi med njimi občutno razlikuje. Namen tega magistrskega dela je jasen prikaz razlik v stopnji varstva človekovih pravic med enaindvajsetimi obravnavanimi postsovjetskimi državami.

Abstract:In accordance with the modern understanding of democratic state and the rule of law, human rights and fundamental freedoms lie in the heart of every society whose basic goal is to ensure wealth and freedom to every individual. In the master's thesis, the history of the USSR is briefly described. Key events of this history which enabled the rise and caused the fall of one of the cruelest totalitarian regimes in modern history are presented chronologically. As a contrast to crushing the dignity and freedom of individuals in the USSR, the mechanisms of the protection of human rights are presented in continuation: those mechanisms established on the international level and those established on the constitutional level of the discussed countries. The central part of the master's thesis is a comparison of twenty-one countries whose predecessors were the republics of the USSR and satellite countries under the political, economic, and ideological influence of the latter. The discussed countries are in different points of the transition which also reflects in the level of protection of human rights. For the purposes of this master's thesis, the main research element among the discussed countries is the membership in the Council of Europe. Because of the availability of statistical data on the number of violations of the European Convention for the Protection of Human Rights and Fundamental Freedoms, it was possible to perform a quantitative comparison among the member states of the European Council, while the comparison between the member states of the European Council and those countries which are no members was only possible on the basis of their constitutional arrangement in force and between the mechanisms of the protection they establish. Even though all the discussed countries included lengthy catalogs of human rights in their constitutional texts, the realization of the latter in practice is significantly different. The purpose of this master's thesis is a clear display of differences in the degree of the protection of human rights between the twenty-one discussed post-Soviet countries.
