Title:Mediacija kot alternativni način razreševanja sporov v civilnem pravu v Republiki Sloveniji : diplomsko delo

Abstract:Ljudje smo v času svojega življenja navzoči, velikokrat pa tudi vpleteni v raznorazne konflikte. Sami pa se odločimo, na kakšen način jih želimo reševati. Ko gre za kompleksne spore, je prva asociacija zastopanje po odvetniku in sodišče. Zakaj ljudje tako radi uporabljamo tak način, če nam je na voljo milejša oblika reševanja spora? Mediacija je ena izmed oblik alternativnega reševanja sporov, pri kateri sprti strani aktivno participirata s pomočjo tretje, neodvisne osebe (mediatorja). Reševanje spora z mediacijo je hitrejše, cenejše, stranki nista nasprotnici, ampak sodelujeta in sta usmerjeni v iskanje rešitev za njun spor. Mediator je del njunega procesa, kjer ju z različnimi tehnikami, skozi različne faze usmerja proti njunemu skupnemu cilju, to pa je rešitev, ki bo za obe stranki sprejemljiva. Alternativne načine reševanja sporov posamezniki še vedno premalo poznajo. S tem ko je bil 19. novembra 2009 sprejet ZARSS, se je to malenkost spremenilo, kajti na podlagi tega zakona, ki se je začel uporabljati 15. junija 2010, morajo sodišča omogočiti uporabo mediacije ali katero drugo obliko reševanja sporov, če ocenijo, da je spor rešljiv tudi na tak način. Kako bodo posamezniki svoje spore reševali, je seveda njihova odločitev, kajti živimo v državi, kjer je omogočena svoboda gibanja, izražanja in vesti na podlagi Ustave Republike Slovenije. Namen tega diplomskega dela je bralce seznaniti, približati in jih mogoče celo spodbuditi, da v prihodnje za reševanje njihovih sporov ne bo prva izbira sodišče, ampak mediacija ali katera druga oblika alternativnega reševanja sporov.

Abstract:People are throughout our lifetime present at, or sometimes even involved in different conflicts. It is up to us, how we handle them.When complex disputes arise, the first association is a representation by attorney in court. Why do people resort to these instead of milder options for dispute resolution? Mediation is one of dispute resolution techniques, where disputants cooperate actively with the help of a mediator. Solving the dispute with mediation is faster, more affordable, and the parties work together and are focused on seeking a solution to their dispute. The Mediator is part of their process, who with different techniques, through different phases of the proceedings pivots participants towards their common goal, which is to find a solution, acceptable to both disputants. Alternative ways of conflict resolution are poorly known among individuals. By adopting the Alternative Dispute Resolution Act on November 19, 2009, this has changed slightly. Under this Act which became applicable on 15. June 2010, the courts must enable usage of mediation or any other technique of conflict resolution, if they consider the conflict solvable using alternative methods. How individuals resolve disputes is their decision, because we live in a country where freedom of movement, speech, and conscience are enabled based on the Constitution of the Republic of Slovenia. The purpose of this diploma thesis is to acquaint, approximate and even encourage readers to handle their future conflicts out of courts, with the help of mediation or one of the other alternative dispute resolution methods.
