Title:Temelji hindujskega prava : diplomsko delo

Abstract:To diplomsko delo je pregled zgodovinskega razvoja hindujskega prava v povezavi s sistemom družbene ureditve, pregled vrednostnega sistema in pogledov na svet ter ugotavljanje vpliva teh faktorjev na ureditev, spreminjanje in razvoj hindujskega prava. Namen tega dela je seznaniti bralce z zgodovinskimi temelji indijske civilizacije in njenega vpliva na ureditev pravnega sistema. To smo dosegli s pomočjo zgodovinske razlage v povezavi s sistemom družbene ureditve, pregledom vrednostnega sistema in pogledov na svet ter z ugotavljanjem vpliva teh faktorjev na ureditev, spreminjanje in razvoj indijskega prava. V prvem poglavju je razložen sam nastanek hinduizma, zgodovinski pregled in razlaga osnov za njegov nastanek ter razvoj, pa tudi za nastanek prava in družbe. V drugem poglavju se naloga osredotoča na vire, ki so pripomogli k razvoju prava, in na njihov pomen. Viri so razdeljeni v štiri skupine, ki skupaj tvorijo pomembno celoto za poznavanje hindujskega prava, njegovega razvoja in postopkov oziroma običajev. V tretjem poglavju bomo pobližje spoznali družbeno ureditev, ki je temeljila na podlagi primarnih nalog pripadnikov družbe oziroma na delu, ki ga v svoji skupnosti opravljajo člani, pa tudi vpliv družbene ureditve na oblikovanje pravnega sistema oziroma vpliv običajev, skozi katere se je pravo starodavne Indije razvijalo.V četrtem poglavju se naloga osredotoča na sam pravni sistem v času starodavne Indije, na njegov razvoj, institucije in pravne postopke.

Abstract:This diploma thesis offers an overview of the historical development of Hindu law in connection with the social system, world view and value system and of the influence of these factors on the system, changes and development of Hindu law. The purpose of this thesis is to acquaint the readers with the historical foundations of Indian civilisation and its influence on the arrangement of the legal system. We will achieve that with the help of historical explanation in connection with the social system, world view and value system and the influence of these factors on the system, changes and development of Indian law. The first chapter explains the origin and historical overview of Hinduism, and explains the foundations for its emergence, and for the emergence of law and society. In the second chapter, the thesis focuses on the sources which contributed to the development of law, and on its importance. The sources are divided into four groups, and altogether they form an important whole for the development and, most importantly, knowledge of Hindu law, its methods or customs. In the third chapter, we will get to know the social system, which was founded on their primary tasks or work which people perform in their society; we will also get to know the influence of this on the formation of their legal system or customs through which the law of ancient India developed. In the fourth chapter, the thesis focuses on the legal system in the time of ancient India, its development, institution and procedures.
