Abstract:Diplomsko delo nam predstavi, katere kriterije mora določena entiteta izpolnjevati, da jo mednarodno pravo šteje za državo. To vprašanje je pomembno zlasti za mini države, ki sicer izpolnjujejo kriterije, vendar nekaterih od njih ne v celoti. Pri tem mislimo predvsem na kriterij neodvisnosti, ki ga ne morejo izpolnjevati celostno zaradi določenih posebnosti, kot je na primer protektorsko razmerje. Najbolj pomembni kriteriji državnosti so efektivna vlada, populacija, definirano ozemlje, sposobnost vstopati v odnose z drugimi državami, suverenost, neodvisnost - zadnja dva kriterija nekateri pravniki enačijo. Opazili bomo, da so štiri države v odnosu odvisnosti, ta odnos odvisnosti nastane s pogodbo o protektoratu, ki služi, da močnejša država ščiti šibkejšo, slednja pa ji prepusti del svojih pravic, kot je na primer upravljanje z zunanjo politiko. Kljub temu da država prepusti upravljanje svoje zunanje politike drugi državi in s tem izgubi del svoje suverenosti, še vedno obstaja kot država. Ena od opisanih držav pa je subjekt sui generis. Diplomsko delo temelji na opisni metodi, saj smo tako lahko prišli do ključnega rezultata. V zadnjem delu je z zgodovinsko metodo opisan obstoj mini držav, da smo prišli do rešitve, kako jim je uspelo vrsto let ostati neodvisne. Pri zunanji politiki držav pa je uporabljena primerjalna metoda, da lahko nazorno vidimo izzive majhnih držav. Namen diplomskega dela je raziskati vprašanje, ali so mini države države z vidika mednarodnega prava, cilj pa je s pomočjo literature, člankov in spletnih strani dokazati, da te države so države.

Abstract:The thesis presents, which criteria have to be met by a certain entity to be recognized as a country under international law. This question is particularly important for mini countries, which otherwise meet the criteria, but some of them not entirely. By saying so, we are particularly thinking about the independency criteria, which cannot be entirely met by them due to certain particularities, like the protectorate relation. The most important criteria of statehood are effective government, population, defined territory, ability to enter into relations with other countries, sovereignty, independency - the last two criteria are being equated by jurists. We will see that four countries are in a relationship of dependency. Such relationship comes to form with a protectorate contract, which ensures that the more powerful country protects the less powerful one and the later gives away some of its rights, like foreign policy management. Despite the fact that the country assigns the management of its foreign policy to another country and thus loses a part of its sovereignty, it still exists as a country. But one of the described countries is a sui generis subject. The thesis is based on the descriptive method, since this way we could come to the crucial result. In the final part, we used the historical method to describe the existence of mini countries and come to the conclusion, how they managed to stay independent for a number of years. In the case of the foreign policy of countries, we used the comparative method to explicitly present the challenges of small countries. The purpose of the thesis was to analyse the question, whether mini countries are countries from the perspective of international law; and the goal is to use literature, articles and websites to prove that these countries are countries.
