Title:Pravne specifike pogodbe o dosmrtnem preživljanju : diplomsko delo

Abstract:Pogodba o dosmrtnem preživljanju je aleatoren pravni posel, ki ga urejajo členi 557 - 563 Obligacijskega zakonika (OZ). Gre za le nekaj členov OZ, ki urejajo obsežno pravno področje civilnega prava na področju obligacijskih razmerij, kar bi lahko vzbudilo napačen občutek, da ne gre za zelo pomembno razmerje. Pogodbeni odnos, ki nastane s pogodbo o dosmrtnem preživljanju, ureja zelo osebna razmerja. Stranke lahko to pogodbo sklenejo tudi zaradi medsebojnega osebnega odnosa in zaupanja. Če pogodbeni stranki tega razmerja v pogodbi ne uredita natančno, lahko ima to zanju hude posledice, povezane z dolgotrajnimi in zahtevnimi postopki na sodišču. Bistvenega pomena pri sklepanju pogodbe o dosmrtnem preživljanju je dejanska volja pogodbenih strank, ki naj jo pogodbeni stranki natančno opredelita. Pravice in obveznosti pogodbenih strank v pogodbi o dosmrtnem preživljanju so le tiste, ki so določene v pogodbi, in v obsegu, kot so zapisane. Prav zaradi pomembnosti odnosov in posledic, ki jih ureja pogodba o dosmrtnem preživljanju, je določena posebna obličnost, to je oblika notarskega zapisa, kjer sta stranki še posebej s strani notarja opozorjeni na pravice, dolžnosti in posledice, ki jih prinaša sklenitev takšnega pravnega posla zanju. Da gre dejansko za pravni posel, ki ureja pomembne medsebojne odnose s številnimi zapleti ob izvrševanju pogodbe in uveljavljanju pravic in dolžnosti pogodbenih strank v primeru odstopanja ali neizpolnjevanja pogodbenih obveznosti, dokazuje tudi sodna praksa, ki se je bistveno spremenila in sedaj dejansko ne dopušča več dokazovanja delne odplačnosti pogodbe in delno darila.

Abstract:The contract on life-long livelihoods is an aleatory legal transaction, regulated by articles 557-563 of the Obligation Code (OC). It is the case of only a few articles of the OC that regulate an extensive legal area of civil law in the field of contractual obligations, which could cause a false sense that this obligation is not of great importance. The contractual relationships, which comes to force with the contract on life-long livelihoods, regulates very personal relations. Parties can also conclude this contract due a mutual personal relationship and trust. If the contracting parties do not regulate this relationship precisely in the contract, this can have severe consequences for them, connected with long-term and demanding procedures before the court. In concluding the contract on life-long livelihoods, the actual will of the contracting parties is crucial and they should define it precisely. The rights and obligations of the contracting parties in the contract on life-long livelihoods are only those, which are set in the contract and to the extent written. Particularly because of the importance of relations and consequences, regulated by the contract on life-long livelihoods, a special form is set; this is a form of a notarial deed, where the notary recalls both parties about the rights, obligations and consequences, coming with the conclusion of such a legal transaction. The fact that we are actually talking about a legal transaction, regulating important mutual relations with numerous complications in the execution of the contract and exercising the rights and obligations of contracting parties in the case of withdrawal or non-compliance with the contracting obligations, is proven by case law, which has significantly changed and now actually no longer allows proving of partial repayment and partial gift.
