Title:Reševanje sporov med zunajzakonskima partnerjema oz. zakoncema v procesu razveze (ločitvena mediacija) : diplomsko delo

Abstract:V zadnjih letih opažamo porast razvez zunajzakonskih partnerjev oz. zakoncev. Za reševanje sporov v času razveze so zakonci oz. zunajzakonski partnerji vedno bolj naklonjeni uporabi mediacije. Teoretični del diplomskega dela zajema opis temeljnih pojmov - zunajzakonska skupnost, zakonska zveza, razveza ter mediacija. Ti so osnova za razumevanje družinske mediacije - enega najbolj uveljavljenih načinov mirnega reševanja sporov v postopkih razveze. Družinsko mediacijo urejajo pravni predpisi, ki hkrati določajo pravila za izvajanje mediacije. Je ena izmed vrst mediacije, ki se uporablja pri reševanju družinskopravnih sporov. Z uzakonitvijo Družinskega zakonika dobi mediacija večji pomen. V diplomskem delu so poudarjene bistvene razlike med novo sprejetim Družinskim zakonikom ter prej veljavnim Zakonom o zakonski zvezi in družinskih razmerjih. Na mediacijskem srečanju ima veliko vlogo mediator. Dobro poznavanje njegovih nalog, tehnik oz. veščin ter samih načel in faz postopka ima vpliv na to, da so mediacijska srečanja uspešna. Kadar gre za družinskopravne zadeve je v samem postopku potrebna še večja preciznost in strokovnost, da se lahko zagotovi varstvo in zaščito otrok. Empirični del je prikaz družinske mediacije v praksi. Na podlagi pridobljenih podatkov okrožnih sodišč lahko ocenimo prisotnost, uporabo, uspešnost družinske mediacije v Sloveniji.

Title:Reševanje sporov med zunajzakonskima partnerjema oz. zakoncema v procesu razveze
Abstract:The last few years, we have been noticing an increase of separation of extramarital partners or spouses. For solving disputes in the time of seperation, the extramerital partners or spouses are more and more keen on using mediation. The theoretical part of the dissertation gathers descriptions of fundamental concepts - consensual union, marriage, seperation and mediation. These concepts are the base for understanding family mediation - one of the most established ways of peacefully settling a dispute in the process of seperation. Family mediation is regulated by legal regulations which simultaneously stipulates the rules of enforcing mediation. It is one of the types of mediation which is used for solving family law disputes. With the legislation of the Family Code, mediation gets a higher meaning. The dissertation emphasizes the fundamentall differences between the newly adopted Family Law and the previously valid Marriage and Family Relations Act. The mediator plays a big part in the mediation meetings. For the mediation meetings to be successful, the mediator has to have great knowledge of his tasks, techniques or skills and phases of the procedure. When it comes to Family Legal matters precision and proficiency are necessary for the protection of the children. The empirical part shows family mediation in practice. Based on information obtained from the Distric Court we can evaluate the presence, use and successfulness of family mediation in Slovenia.
